Mr. Hendriksen inquired if the Council wanted him to come back to the next meeting to <br />which Mayor Gilbertson replied that would be okay. <br /> <br />Councilmember Beyer stated that it is perfectly clear that the City has been in the wrong all <br />these years. <br /> <br />Mayor Gilbertson reiterated he needs to review the information he had just received. <br /> <br />Councilmember Beyer stated it is clear the City ordered a project and then stopped it. "The <br />City has been wrongfully dumping water on private property - it's wrong - we have to stop <br />it." <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to direct <br />City Staff to respond to information received from Mr. Terry Hendriksen and present a <br />solution as soon as possible. <br /> <br />Further discussion: Counciln~ember Zimmerman stated that he wants to get this issue <br />resolved. Mayor Gilbertson reiterated that time is needed to absorb the information <br />received this evening. Mr. Hendriksen stated he can appreciate Council wanting time but it <br />is getting late in the construction year. Mayor Gilbertson stated that the time talked about is <br />only two weeks. Mr. Hendriksen stated that if an alternative can be worked out and <br />directed at the next Council meeting, he will be satisfied. Councilmember Hardin inquired <br />of Mr. Hendriksen what he is proposing. Mr. Hendriksen stated that the drainage should <br />be maintained and the City needs to accept responsibility. The damming up should be the <br />City's problem. He stated that Stanley Welsh's roadway is creating a dam. The filling by <br />Gobernatz and Swanson is creating a problem. There are several dams retarding the <br />drainage. The water needs to be at a reasonable level, below the level of the culverts. He <br />suggested these are solutions to cure this problem. He added that he does not want to <br />spend a lot of money to have a lawsuit. Councilmember Zimmerman stated that he is not <br />too happy to see water on a new street and flooding in the springtime and that this issue <br />needs to get settled. Mr. Hendriksen stated he will be happy if, at the next Council <br />meeting, City Staff is directed to do something to resolve this issue. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #5: Updale on Traffic Issues on Dysprosium Street N.W. <br /> <br />City Engineer Jankowski stated that on July 12, 1994, Council was presented with a <br />petition signed by 93 residents of the Flintwood Hills development. Specifically, this <br />petition requested placing four-way stops at the intersections of 141st and 143rd Streets <br />N.W. with Dysprosium and further requested that speed bumps be placed between each <br />intersection along Dysprosium. The petition suggested that problems have been <br />experienced on this section of road which include a speeding car striking a child, speeding <br />car striking a house, speeding cars losing control and leaving the roadway, and cars <br />traveling in excess of 50 miles per hour. Mr. Jankowski stated he asked Police Chief <br />Auspos to review the accident records for the 9.5 year period for this stretch of <br />Dysprosium (south o~' the water tower to the intersection with Industry Avenue N.W.). <br />There were a total of 10 accidents (six were at the intersection with County Road #116). <br />The remaining four property damage accidents involved only one vehicle/fixed object <br />accident. Since this accident occurred prior to 1993, the details are not immediately <br />available to Police Staff. The nine-year record showing four accidents on this street <br />segment isn't excessive, considering the size and use of this street and its potential for <br />traffic flow. <br /> <br />City Council/July 26, 1994 <br /> Page 13 of 27 <br /> <br /> <br />
