City Administrator Schroeder suggested that this is a legal opinion expressed that does not <br />concur with Staff's recommendation; therefore, City Attorney Goodrich should address <br />this issue. <br /> <br />City Attorney Goodrich stated that as it's proven the City needs the easement for drainage, <br />it seems this is a necessary reqt, irement. <br /> <br />Mr. Jankowski stated there needs to be some area for the water. We also know we should <br />plan ahead for a service road and it seems the logical place would be along the raih'oad <br />tracks. <br /> <br />Mr. Goodrich stated there would be compensation for the drainage and utility easements. <br /> <br />Mr. Knetsch stated that what he objects to is the mixture of the road and the drainage. He <br />agreed that there is a need tot' the drainage. He suggested that until the use for the land is <br />known, that a 10 foot drainage easement be given across the back of the lots and at the time <br />any development occurs, yot~ could address the issue at that time. "The road is a speculator <br />issue, it's not fair. The City has made no finding that it needs 60 feet for drainage." <br /> <br />Mr. Jankowski stated that more than 10 feet is needed for drainage. He stated that Mr. <br />Knetsch is correct that the City would know more what is actually needed for drainage <br />when the exact land use is detem~ined. He added that this area is the most logical area for a <br />future road. <br /> <br />Mr. Knetsch inquired of Mr. Jankowski if he agreed that this property does not generate <br />the need for a road in that area. <br /> <br />Mr. Jankowski staled tha~ the road would be needed only if the access on Highway #10 <br />was closed; right now there are two accesses to Highway #10 from the property. <br /> <br />Ben Deemer, 14501 Sunfish Lake Boulevard N.W., Ramsey, stated that the City has <br />required a drainage easement on the rear of other properties along Highway #10. <br /> <br />Mr. Knetsch stated that when the property is developed, the drainage will be taken care of <br />at that time. <br /> <br />Councilmember Zimmerman inquired what the recommendation of the Planning <br />Commissio~l was. <br /> <br />Mr. Deemer stated lhat tile Staff review letter stetted this was for a drainage and utility <br />easement and the Plannino.~ Commission approved it as such. <br /> <br />Mr. Goodrich added that tile law states that the dedication of the amount required has to be <br />for what the needs are. Iqe recommended asking the City Engineer to recalculate and revise <br />what the plat will need for drainage, not calculate it on a fUture plan for a road. <br /> <br />Councilmember Hardin stated that a drainage plan is required prior to being granted <br />approval. <br /> <br />Upon inquiry if there is enough infommtion to make a determination, Mr. Jankowski stated <br />he would estimme it b~tscd upon other developments. <br /> <br />Motion by Cot,ncilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #94-07-149 granting final plat approval to Guy Addition contingent upon the <br /> <br />City Council/July 26, 1994 <br /> Page 18 of 27 <br /> <br /> <br />
