developer providing the required drainage and utility easements to the satisfaction of the <br />City Engineer. <br /> <br />Further discussion: Ms. Frolik stated that in addition, the City will be requiring the <br />standard 10' easement around all lots. Mr. Jankowski stated that the property will be <br />allowed only the two accesses and they must decide where to put them. Mr. Knetsch <br />understood about the two accesses and determined they would be left where they are. <br /> <br />Motion carried. Abstain: Mayor Gilbertson. <br /> <br />Case #10: <br /> <br />Request for Revised Preliminary Plat of Chestnut Hill; Case of <br />John Pelerson, Good Value ttomes <br /> <br />Zoning Administrator Frolik stated that in May 1990, the City Council granted preliminary <br />plat approval to Chesmut Hill. The final phase of Chestnut Hill included an extension to <br />145th Lane N.W. to the west boundary of the plat that would turn north and connect to the <br />future Sunwood Drive. The extension of 145th Lane N.W. included crossing a wetland. <br />There was also a preliminary plat revision approved in 1993, but it did not affect the <br />alignment of the western portion of 145th Lane N.W. Ms. Frolik commented that since <br />1990, wetland regulations have become more stringent and it is no longer possible to <br />construct roads through them, even with mitigation, if there is an alternative route. Thus, <br />the developer has submitted a request for revised preliminary plat to end the western <br />portion of 145th Lane N.W. in a cul-de-sac with no extension through the wetland and no <br />connection with Sunwood Drive N.W. Ms. Frolik informed Council that on June 6, 1994, <br />the Planning Commission conducted a public hearing regarding the proposed revision. <br />Residents of Hunter's Hill expressed dissatisfaction with the potential loss of another outlet <br />to a collector street by the elimination of 145th Lane N.W. intersecting Sunwood Drive. <br />The public hearing was continued on July 5, 1994, where Mr. Peterson proposed that <br />Chestnut Hill 5th Addition extend 145th Lane N.W. as a through street to Sunwood Drive <br />N.W. with minimal impact to the wetland. The newly proposed alignment of 145th <br />resulted in a remnant of p,'operty on the west side of the street that at the time was proposed <br />to be conveyed to Mr. Deemer, the adjacent property owner to the west, for the purposes of <br />platting. The Commission recommended revised preliminary plat approval contingent <br />upon a recommendation from the Park and Recreation Commission as to whether or not a <br />trail connection is desirable between Hunter's Hill Park and the Sunwood Drive Trail. Mr. <br />Deemer and Good Value Homes has since entered into a purchase agreement wherein Good <br />Value would purchase a sufficient amount of property from Mr. Deemer to combine with <br />their remnant on the west side of 145th. This acquisition would enable Good Value Homes <br />to create three more lots on the west side of 145th without Mr. Deemer's participation in the <br />plat. Ms. Frolik informed Council that the Park and Recreation Commission reviewed the <br />revised preliminary plat and recommended that the park dedication be amended to require a <br />trial link in the 5th Addition that connects Hunter's Hill Park with the Sunwood Drive <br />N.W. trail. The developer has agreed to provide a preliminary plat indicating the inclusion <br />of such trail. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to <br />approve the revised preliminary plat roi' Chestnut Hill contingent upon the developer <br />entering into a development ag,'eement with the City and resolution of the trail easement <br />situation. <br /> <br />Motion carried.
