Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />the resolution establishing criteria for consideration of development outside the <br />Metropolitan Urban Service Area. <br /> <br />Further discussion: Councilmember Hardin inquired how they would be able to make any <br />decisions based on this document. He felt the way it's worded is nebulous and that it <br />should be reworded. He pointed out some of the problem areas. He suggested it would be <br />impossible to use this as a working document as there are a lot of questions as to what <br />would or would not be allowed. Mr. Schroeder stated that if Council is looking for <br />numbers, this document does not provide that; it provides City Council with a discretionary <br />road map. If it's an improvement in the areas identified, then perhaps it would be <br />acceptable. Councilmember Hardin stated that any developer can say it's an improvement. <br />This can be used to develop a high density ina rural area. Mr. Schroeder stated if the City <br />had large tracts of undeveloped land that would allow this, then I would agree with you; <br />however, we do not. This would allow the opportunity to develop outside the MUSA. <br />Councilmember Hardin stated the document is too vague, anyone can say they meet the <br />criteria. Mr. Schroeder stated that the intent is they must meet all the criteria. <br />Councilmember Hardin stated that, for example, public amenity is not defined; it's just too <br />vague. Councilmember Peterson commented that the final word is up to the Council to <br />determine what's in the best interest for the City. Councilmember Hardin agreed but stated <br />that the City may get a number of requests, Precedents may be referred to and it may not be <br />good for the City. He requested it be written with some definition. Mr. Schroeder stated <br />that could be done. City Attorney Goodrich stated that the zoning ordinance will be used, <br />which is the law of the City, and suggested that maybe the zoning ordinance should include <br />this document. <br /> <br />Councilmember Peterson withdrew his motion and Councilmember Zimmerman withdrew <br />his second. <br /> <br />Council directed that Staff include definitions for clarity of the Exurban Development <br />Policy and bring it back to a subsequent meeting for Council review. <br /> <br />Case #6: County Road #116 Trailway Eminent Domain <br /> <br />City Attorney Goodrich stated that City Council authorized proceeding with acquisition of <br />permanent park trail easement by eminent domain for the County Road #116 trailway <br />project. The appraisal value is $9,100 and Staff is requesting authorization to deposit the <br />appraisal value with the court. The amount is within the 1994 park budget allocation. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to <br />approve the appraisal as fair and reasonable and to authorize payment in the amount of <br />$9,100 to landowner or deposit same amount with district court for purpose of <br />condemnation action by the City Attorney. <br /> <br />Motion carded. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman, <br />and Hardin. Voting No: None. Absent: Councilmember Beyer. <br /> <br />Mayor Gilbertson recessed the regular Council meeting at 8:45 p.m. <br /> <br />Mayor Gilbertson reconvened the regular Council meeting at 8:59 p.m. <br />Case #7: Waste Management of Minnesota, Inc. Ski Hill Agreement <br /> <br />City Administrator Schroeder stated that the City has been working with Waste <br />Management of Minnesota, Inc.
