Motion carried. Voting Yes: Councilmembers Zimmerman, Beyer, Hardin and Peterson. <br />Voting No: Mayor Gilbertson. <br /> <br />Mr. Mike E. Powers of Anoka stated he owns land on Highway #47 and County Road <br />#63. He stated if his land is measured to the middle of the road, he has 2.5 acres, if the <br />road is not used, he has 2.3 acres. <br /> <br />Zoning Administrator Frolik stated this is platted property and it would be measured from <br />property line to property line. <br /> <br />Mr. Powers stated he would like to build a pole building and 2.5 acres of land is needed for <br />that. He stated he was told by Mr. Gerald Bauer and by his attorney that he has 2.5 acres <br />of land. <br /> <br />Mayor Cdlbertson stated it doesn't matter what Mr. Bauer or Mr. Powers' Attorney say, his <br />acreage is determined as stated by Ms. Frolik. <br /> <br />Mr. Powers stated he bought a 2.5 acre parcel and now Ms. Frolik and the Building <br />Official are saying that he has 2.3 acres. <br /> <br />City Attorney Goodrich stated that Ms. Frolik is correct. <br /> <br />Mayor Gilbertson suggested that Mr. Powers could apply for a conditional use permit. <br /> <br />Mr. Powers stated he wants to build a house where the pole building is now. <br /> <br />Ms. Frolik stated that Mr. Powers is proposing to tear down the pole building; however, <br />grandfather rights would then be lost. <br /> <br />Mr. Powers stated he would like to build a 28' x 60' building - the building there now is <br />28' x 40'. <br /> <br />Mayor Gilbertson suggested that Mr. Powers meet with Ms. Frolik to see if anything can <br />be done. <br /> <br />APPROVE AGENDA <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to <br />approve the agenda as amended. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman, <br />Beyer and Hardin. Voting No: None. <br /> <br />CONSENT AGENDA <br /> <br />Councilmember Beyer inquired if Staff just decided to set the date for the first Council <br />meeting in September. <br /> <br />Finance Officer Hart stated that the date had to be changed because of the Primary Election <br />and that Council had previously voted on that change. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to approve <br />the following items on the Consent Agenda: <br /> <br />City Council/August 22, 1994 <br /> Page 3 of 17 <br /> <br /> <br />
