Mr. Jankowski stated he is not sure there has been a situation like this before. It's been the <br />City's policy if a lot fronts both a county road and a city street, when an improvement is <br />done by the county, there is no assessment but when an improvement is done to the City <br />street, the property owner will be assessed a full share. <br /> <br />Discussion ensued regarding deferring the assessment until Mr. Gobernatz would <br />subdivide the property. <br /> <br />Councilmember Zimmerman inquired what would happen to the assessment if Mr. <br />Gobernatz did not subdivide in 10 years <br /> <br />Mr. Goodrich replied that the assessment would then be gone. <br /> <br />Mr. Gobernatz stated he has heard about people going in and combining lots so as to be <br />assessed for only one. <br /> <br />Councilmembers Peterson and Hardin stated they would be willing to defer the assessment. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hardin to close <br />the public hearing. <br /> <br />Motion carried. Voting Yes: Councilmembers Peterson, Zimmerman and Hardin. Voting <br />No: None. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />The public hearing adjourned at 7:42 p.m. <br /> <br />Council Boniness <br /> <br />Councilmember Peterson called the regular portion of the City Council meeting back to <br />order at 7:42 p.m. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Zimmerman to adopt <br />Resolution #94-10-235 adopting assessment, as amended showing the deferred <br />assessment, for Improvement Project #93-12 (Bituminous surfacing of 177th Avenue <br />N.W. from St. Francis Boulevard N.W. to its Eastern Terminus). <br /> <br />Further discussion: Councilmember Hardin stated that the assessment would be deferred <br />up to 10 years or until it is subdivided or improved. City Attorney Goodrich inquired if <br />Council intended to charge interest to which it was stated the lot would bear interest, <br />starting now. Mr. Gobernatz stated that is not fair. Mr. Gobernatz presented the <br />Recording Secretary with a note stating he is opposed to the assessment because of the <br />interest. Such note will be filed in the Improvement Project file. <br /> <br />Motion carried. Voting Yes: Councilmembers Peterson, Hardin and Zimmerman. Voting <br />No: None. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Case #15: <br /> <br />Proposed Assessment for Improvement Project #93-13 <br />(Bituminous Surfacing Improvement of 164th Lane N.W. <br />between Nowthen Boulevard N.W. and its Western Terminus) <br /> <br />Councilmember Peterson adjourned the regular portion of the City Council meeting at 7:44 <br />p.m. in order to conduct the public hearing. <br /> <br />City Council/October 11, 1994 <br /> Page 16 of 29 <br /> <br /> <br />
