Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Peterson to adopt <br />Resolution ~t/94-10-237 adopting Findings of Fact #0369 relating to KRS Investments' <br />request to expand an outdoor recreational facility in the Industrial District. <br /> <br />Motion carried. Voting Yes: Councilmembers Hardin and Peterson. Voting No: <br />Councilmember Zimmerman. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />With regard to the conditional use permit, Councilmember Hardin suggested changing the <br />90 days to remedy a complaint to 30 days and to include language that adequate netting will <br />be installed on both the north and the south sides to a distance of 250 feet. <br /> <br />Mr. Ritter felt that the 30 days is not a problem except that he doesn't know how long it <br />takes to manufacture the netting - that may take longer than 30 days. <br /> <br />Ms. Frolik asked for clarification on the netting: Should it be put up right away, or only if <br />a problem arises. <br /> <br />Councilmember Hardin suggested leaving the number of days off and add "as adequate to <br />eliminate any problems - when and if a problem arises. <br /> <br />Councilmember Peterson suggested that taking out three tee m'eas may solve the problem. <br /> <br />Councilmember Hardin commented it should be enough language to remedy any problem. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Peterson to amend #3 <br />of the conditional use permit to read .... The permit holder shall be responsible to remedy <br />any complaints from property owners regarding stray golf balls within thirty (30) days of <br />notification of said complaint. The remedy may consist of installing additional netting or an <br />alternative solution acceptable to the City.
