Mr. Gobematz argued that it is not a lot of record.

City Engineer Jankowsld stated that it is a lot of record and there is a house on the lot.
There is access to it from Highway #47. The lot that has frontage along 177th Avenue
N.W. should be assessed the whole share.

Mr. Goodrich read the deferment guidelines and stated that all has to be accomplished in 30
years. If nothing happens, it would be activated in 21 years.

Mr. Gobernatz stated that Council could abate this assessment forever until he subdivides.

Mr. Goodrich reiterated that Council cannot do that. He then asked if he could build
another house on the lot without subdividing.

Mr. Schroeder stated that Mr. Gobernatz is allowed four parcels in 40 acres.

Mr. Gobcmatz stated this is an ouflot that happens to have frontage on Highway #47. He
stated he cannot build unless he subdivides and added that he felt his neighbors "put one
over on him".

Councilmember Beyer stated that the project in question did increase the value of Mr.
Gobematz' property and inquired if the issue is whether to defer it 10 years or 20 years.

Mr. Gobernatz stated he is not interested in deferment, he wants it taken away and added
that he is trying to figure out why the City is calling it a lot.

Mayor Gilbertson commented that it is a nominal amount of money.

Mr. Gobematz questioned it it's so nominal, why doesn't Council just abate it.

Mr. Schroeder suggested deferring the assessment for a 10-year period at a normal interest
rate.

Councilmember Beyer stated that the interest could be deferred for 10 years and at the end
of the tenth year, Mr. Gobernatz could pay if off with no interest, or if he subdivides, he
would have 10 years from that date to pay it off.

Motion by Councilmember Beyer and seconded by Councilmember Hardin to maintain
deferment for ten years from improvement or subdivision. Interest will begin on activation
only.

Further discussion: Ms. Hart explained that whatever the interest rate is at that time of
payoff, Mr. Gobematz would pay two percent over prime. She added that Mr. Gobematz
has to start paying for the assessment at the end of 10 years to which Mr. Gobematz replied
"no problem".

Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin, Peterson
and Zimmerman. Voting No: None.

2) Tax Increment

City Administrator Schroeder informed Council that because of Anoka Electric
Cooperafive's utility extension, Staff has proposed to amend the existing tax increment to

City Council/October 25, 1994
