Case #3: Request for Final Plat Approval of Northfork Oaks; Case of <br /> North Fork, Inc. <br /> <br />Zoning Administrator Frolik stated that North Fork, Inc. is requesting final plat approval of <br />Northfork Oaks. The plat is proposed to be 29 acres divided into 13 single family lots. <br />The lots are proposed to receive public access from the extension of 160th into the plat with <br />a cul-de-sac extending off this through street. Street names need to be applied to the plat. <br />It is Staffs understanding that the developer will be requesting to deviate from the street <br />grid system to name the cul-de-sac Royal instead of Rabbit. There is no park dedication <br />due on this portion of the P.U.D. in accordance with the May 9, 1989 Northfork Park <br />Dedication Agreement. Ms. Frolik reported that Mr. Chuck Delaney, owner of Armstrong <br />Kennels to the east of Northfork, has expressed some concerns about the development <br />encroaching on his business. She explained that the 75' strip of property that abuts Mr. <br />Delaney's property would be prohibited from any clearance of vegetation or mature trees. <br />Persons interested in the property would be told there are kennels in the area so there would <br />be barking and occasionally gun shots. She stated she does not have a definite answer <br />from Mr. Delaney and she is recommending approval to Northfork Oaks contingent upon <br />compliance with Staff review letter and a favorable agreement between North Fork, Inc. <br />and Mr. Delaney. <br /> <br />Councilmember Peterson inquired if there are other addresses on Rabbit Street that would <br />become confusing if the developer is allowed to change the street name to Royal. <br /> <br />Ms. Frolik stated there are other addresses on Rabbit Street but they would not be affected <br />because they are not in the North Fork P.U.D. <br /> <br />Dennis Peck, North Fork, Inc., stated that the grid falls between Rabbit and Sloth Street <br />and that he would prefer the name Royal Street. He added that he had spoken with Mr. <br />Delaney's attorney and stated he was going to call Ms. Frolik to let her know that Mr. <br />Delaney was in agreement with everything. Mr. Peck reported that he had spoken with the <br />City's Parks/Utilities Coordinator Mark Boos regarding the City's policy of planting two <br />trees and has arranged to have the trees placed on the new trail corridor instead. <br /> <br />Councilmember Zimmerman inquired if Mr. Peck had a problem with the prohibitions for <br />the 75' strip of property that abuts Mr. Delaney's property to which Mr. Peck replied, no, <br />North Fork had actually proposed that idea. <br /> <br />Police Chief Auspos commented that the different street names in North Fork do not really <br />create a problem for 911, etc., however, there may be other areas requesting to do the <br />same. <br /> <br />Ms. Frolik stated that deviations have been in North Fork and the last time a street name <br />was deviated from, she called the 911 office and they said it was no problem as long as we <br />noted to them the deviation. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #94-10-243 granting final plat approval to Northfork Oaks contingent upon <br />compliance with City Staff Review Letter dated October 14, 1994, and a favorable <br />agreement between North Fork, Inc. and Armstrong Kennels. <br /> <br />Motion carried. Voting Yes: Mayor Gilbenson, Councilmembers Zimmerman, Beyer and <br />Peterson. Voting No: None.
