Voting No: None.

Case #11: Amendment to Section 9.03.04 Titled Conditional Use Permits

City Administrator Schroeder stated that in review of the City's Comprehensive Plan, the
Metropolitan Council has informed us that we have a major glitch in the procedure for
issuing Conditional Use Permits. This is based upon the City not listing that when a
structure is greater than 200 feet in height, it will notify the Minnesota Department of
Transportation. He presented a proposed ordinance that would amend Section 9.03.04 to
include notification of MnDOT. He stated that the Planning Commission conducted a
public hearing on the proposed ordinance and no verbal or written comments were
received. Staff and the Planning Commission are recommending introduction and finally
adoption of the ordinance mending this section.

Motion by Councilmember Hardin and seconded by Councilmember Zimmerman to
introduce the ordinance amending Chapter 9 of the Ramsey City Code to include
notification of MnDOT if the height of a building exceeds 200 feet above ground level.

Motion carded. Voting Yes: Mayor Gilbertson, Councilmembers Hardin, Zimmerman,
Beycr and Peterson. Voting No: None.

Case #1:t: Anoka Electric Cooperative Development Agreement

City Administrator Schroeder stated that the purpose of this case is to request Council
approve the Anoka Electric Cooperative Development Agreement He stated the agreement
is standard form with a couple of changes. Because it's not a tax increment district but an
economic development district, we have to deal with some district issues. He explained
that the numbers in the agreement relate to SAC, WAC, etc. The numbers are estimates;
however, the actual numbers will be supplanted when they are known.

Councilmember Beyer inquired if this agreement had been reviewed and approved by the
City Attorney.

City Attorney Goodrich stated he had not reviewed it.

Councilmember Beyer stated an agreement is important and should be reviewed and
approved by the City Attorney first.

Motion by Councilmember Beyer and seconded by Councilmember Peterson to approve the
Anoka Electric Cooperative Development Agreement contingent upon approval of the City
Attorney.

Motion carried. Voting No: None.

Case #13: Waste Management of Minnesota Property Acquisition

City Attorney Goodrich handed out some materials pertaining to the Waste Management
property acquisition. He stated that what shows on the map he distributed is a 300 foot
setback from the toe of the landfill. The Minnesota Pollution Control Agency requires it be
reserved for Waste Management. The City is asking for street access to our parcel from
151st Avenue N.W. On the 22 acres, we will be required to give easement to them.
Relating to the drainage basin - they will need access from 153rd Avenue N.W.
