Motion by COmmissioner Deemer and seconded by Commissioner Henddksen to separate Finding #28 into two ~eparate findings. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, Holland, LaDue, Terry and Thorud. Voting No: None. Absent: None. Motion by COmmissioner Deemer and seconded by Commissioner Terry to amend Finding 28A to read "That th~ proposed use will involve uses, activities, processes, materials and equipment and conditions of operation that will be detrimental to persons, property or the general welfare by reason of excessive production of smoke, fumes or odor." Motion carried, Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Holland and Thorud. Vot"[ng No: Commissioners Hendriksen and LaDue. Absent: None. Commissioner Hendriksen referred back to Finding #27 and stated that, looking back at all the meetings, it should be amended to read that the proposed use will create excessive additional requirements/it public cost. Ms. Frolik stated that Mr. Karst does pay for City costs incurred in administering his CUP. Commissioner Terry mentioned that the CUP pertains to Lot 1, yet Mr. Karst proposes a building to be built on Lots 2 and 3. He then inquired whether Mr. Karst would need another CUP for Lots 2 and 3. Ms. Frolik stated the need for a CUP depends on the proposed use. Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend Finding #27 to read "That the proposed use will create excessive additional requirements at public cost..." Motion failed.. Voting Yes: Commissioners Hendriksen and Deemer. Voting No: Chairperson Bawden, Commissioners Holland, LaDue, Terry and Thorud. Absent: None. Motion by Commissioner Terry and seconded by Commissioner Thorud to amend Finding #29 to read "That the iproposed use will not be unduly dangerous or otherwise detrimental to persons..." Motion carded. Voting Yes: Chairperson Bawden, Commissioners Terry, Thorud, Deemer, Holland and LaDue. Voting No: Commissioner Hendriksen. Absent: None.
