It was quite evident to <br />Holland that Mr. Karst had done some clean-up work. Commissioner Holland <br /> Karst pointed out some trucks on Lots 2 and 3 that would be stored indoors if <br />.difional use permit (CUP). <br /> <br />Dan Karst, owner of Danny's Tranny's, advised that he's looking to take Lots 2 and 3 and put up <br />a 12,500 sq. ft. building with no outside storage allowed. He stated he did not dispute the fact that <br />the semi was~n the street and that he took care of the problem immediately. He mentioned that <br />there was not~ing in his CUP today or in any City ordinance that says he cannot unload in the <br />street. He afffh--med that he is willing to include Lot 4 for no outside storage if he is granted the <br />CUP. <br /> <br />City Administrator Schroeder stated Staff feels that granting the CUP and allowing the 12,500 sq. <br />ft. building with no exterior storage can only be an improvement. <br /> <br />Commissioner Deemer pointed out terms 15, 16 and 19 to Mr. Karst so there could be no <br />ambiguity in the future, and Mr. Karst stated that he understood. <br /> <br />Commissioner Deemer explained the intent of term 19 is to prevent dormant trailers from sitting out <br />on Lot 4. <br /> <br />Jerry Martin, [business owner at 14021 Basalt Street, stated he is not against Mr. Karst expanding <br />his business §ut is against the manner in which he has conducted his operation until the present. <br />He suggested ihat the City do monthly on-site inspections to ensure compliance with his CUP. <br /> <br />City AdminiStrator Schroeder stated that neighborhood concerns arose at the time of Mr. Karst's <br />last CUP ren~,wal, and he advised that City Code Enforcement Staff is down there at least once a <br />week and he iiimself is down there at least once a month. Mr. Schroeder stated that he has noticed <br />since the last CLIP approval that things have been steadily improving. <br /> <br />Mr. Martin stated he has also noticed an improvement but that he would like it to continue. <br /> <br />The Commislion reviewed the proposed findings of fact as amended at their regular meeting on <br />June 1, 1993~ <br />Motion by COmmissioner Deemer to bold or highlight the words "The proposed use" wherever <br />they occur in the findings of fact. <br /> <br />Motion dies for lack of a second. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt, the proposed resolution accepting the amended findings of fact relating to Danny's <br />Tranny's, Ine?s request for a conditional use permit. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, Lo. Due, and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />The Commission proceeded to review the terms of the CUP. <br /> <br />Motion by Commissioner Deemer and seconded by Commission Holland to amend the legal <br />description ufider the first WHEREAS to read "Lots 2, 3 and 4, Block 4, Gateway North..." <br /> <br />Planning & Zoning Commission/June 7, 1993 <br /> Page 2 of 5 <br /> <br /> <br />
