I <br />I <br />ie <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Ms. Frolik stated that the signed agreement for Rivenwick did not show any responsibility for the <br />vacation of the easement. <br /> <br />Dean Rick, 6802 - 137th Avenue N.W., husband of Sharon Wagner - stated that their house was <br />the first one built in Riverside West 14 years ago, yet they were never notified of the public hearing <br />when the wa~er and sewer came through. He stated they have close to $25,000 in assessments for <br />the sewer an~t water on both lots, plus park dedication, if they want to split. He feels he should <br />not be chars ~b, xl for the sewer and water on his existing lot, only on the new lot. He also feels he <br />should notl~ assessed for the vacation of the easement because the street was put through to <br />benefit the R~venwick development, and he would have prefenexl to keep his quiet cul-de-sac. <br /> <br />City Enginec~r lankowski agreed that both sides of the cul-de-sac should be vacated. He suggested <br />getting the discussion of City Council as to whether Rivenwick, the City, or the individual <br />property ow~ers are responsible for the vacation. He discussed the City's cost_s, for bringing the <br />sewer and ~ater past Riverside West and into Rivenwick and also the City s policy for the <br />property own~s iresponsibility for those costs when subdividing. <br /> <br />Motion by C~mmissioner Holland and seconded by Commissioner Deemer to approve the sketch <br />plan for SharOn Lee Addition and recommend that the applicant proceed to City Council for plat <br />approval, eongingent upon verification that the existing home and the new home will meet side yard <br />setback requite~ ments if the lot is split. <br /> <br />Motion carri~d. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, LaDue, <br />Terry, and Tliomd. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />IO <br /> I <br /> I <br /> I <br /> <br />Motion by ~ommissioner Deemer to recommend to City Council that all assessments for <br />improvement~ be made only to new lots cxr~ted in this development. <br /> <br />Motion dies f~ lack of a second. <br /> <br />Case 02: !Proposed Ordinance to Vacate a Portion of the Street Easement on <br /> 'r 137th Avenue N.W. in the Plat of Riverside West <br /> <br />Zoning Admi~istr_ator Frolik stated that, in conjunction with the proposed minor subdivision of <br />Sharon Lee A~dition, the City is proposing to vacate the southern portion of the cul-de-sac located <br />along 137th Avenue N.W. She explained that the cul-de-sac is no longer needed as the road is <br />now a througi~ street connecting into the Rivenwick Addition. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Dean Rick, 6802 - 137th Avenue N.W., property owner affected by the vacation, stated that the <br />City could ke4p the easement if they were going to assess him for the cost of vacation, because he <br />didn't want to~ay to get something back that should have been his to begin with. <br />Motion by C~mmissioner Deemer and seconded by Commissioner Thorud to introduce the <br />proposed ordi~,ance authorizing vacation of street right-of-way on the north and south side of <br />137th Avenue iN.W. (both eyebrows) in Riverside West Addition, and not assessing the property <br />owners. <br /> <br />Further DiscuSSion: Commissioner Thorud mentioned that another public hearing may be required <br />because there ~as no notice to vacate the eyebrow on the north side of the cul-de-sac. Chairperson <br />Bawden statedithere was no urgency to vacate these easements. <br /> <br />Amendment bY Commissioner Holland and seconded by Commissioner Terry to table discussion <br />of the proposed ordinance until the August meeting of the Commission. <br /> <br />Planning & Zoning Commission/July 6, 1993 <br /> Page 3 of 6 <br /> <br /> <br />
