1 <br />! <br /> <br />Case #2: i Request for a Conditional Use Permit for an Accessory Apartment in <br /> ~ the R-1 Rural Residential District; Case of Curtiss Titterud <br />Zoning Adm~istrator Frolik stated that Curtiss Titterud has applied for a conditional use permit to <br />maintain anficcessory aparnnent in the lower level of his home at 6865 - 162nd Lane N.W. She <br />explained tha~ the Titteruds are retired and live out-of-state 6 months of the year and that they rent <br />the lower level of their home to provide year around security and caretaldng for their property. She <br />added that th~ Tittemds have provided the City with a petition signed by area residents stating no <br />objection to ~e request. <br /> <br />The Planningland Zoning Commission proceeded to review the Findings of Fact. <br /> <br />It was the consensus of the Commission that #1 through #12 would remain as presented <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend findings #13 <br />through #18 iia the affirmative. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, La.Due, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Motion by COmmissioner Terry and seconded by Commissioner Deemer to recommend that City <br />Council adopt the amended Findings of Fact relating to Curtiss Tittemd's request for a conditional <br />use permit for.. an accessory apartment. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Terry, Deemer, Hendriksen, <br />Holland, LaDpe, and Thorud. Voting No: None. Absent: None. <br /> <br />The Planning ~and Zoning Commission proceeded to review the terms of the CUP. <br /> <br />Ms. Frolik explained that the ordinance was drafted to remain in effect coincidental with the <br />Titterud's ter~porary occupancy and ownership. It was the consensus of the Commission to <br />amend term #¢ to read "That said Permit shall remain in effect so long as the conditions imposed <br />herein are complied with and the Permit Holder retains ownership of the Subject Property." <br /> <br />Motion by Commissioner Terry and seconded by Commissioner LaDue to delete term #3. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Terry, LaDue, Deemer, <br />Hendriksen, Holland, and Thomd. Voting No: None. Absent: None. <br /> <br />Motion by Co~nissioner Deemer and seconded by Commissioner LaDue to recommend that City <br />Council approve Curtiss Titterud's request for a conditional use permit for an accessory apartment <br />at 6865 162nd Lane N.W., and accordingly adopt the resolution, as amended, declaring terms of <br />same. <br /> <br />Motion carrie.~l. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Hendriksen, <br />Holland, Ter0, and Thorud. Voting No: None. Absent: None. <br /> <br />Commissioner Deemer noted that Mr. Titterud's home is a successful example of a dwelling which <br />was moved in~o the City. <br /> <br />It was the consensus of the Commission that it would be appropriate for the City to establish some <br />guidelines to ~gulate accessory apartments within the City. <br /> <br />Planning & Zoning Commission/September 7, 1993 <br /> Page 3 of 5 <br /> <br /> <br />
