COMMISSION BUSINESS <br />Case #1: Request for a Conditional Use Permit for Enclosed Organic Compost <br /> ',Facility; Case of International Process Systems, Inc. (a Sister <br /> .Company of Waste Management of Minnesota) <br /> <br />Chairperson Baw. den stated that he and Commissioner Deemer have volunteered to visit two <br />similar facilities in New York operated by International Process Systems 0PS). They will then <br />give a presentation regarding their visit at the City Council meeting of December 14, 1993, and <br />anything procegsed tonight will be contingent upon input from that visit. <br /> <br />Zoning Administrator Frolik advised that a meeting took place earlier in the day with Staff, IPS, <br />and Waste Maflagcment of Minnesota (WMM) in which a number of changes were made to the <br />Findings of Fa~t and terms of the conditional use permit (CLIP). Therefore, she distributed revised <br />documents for ~e Commission's review which supersede those in the agenda. <br /> <br />The CommissiOn proceeded to review the Findings of Fact. <br /> <br />It was the consensus of the Commission that #1 through #15 would remain as presented. <br /> <br />Motion by Chairperson Bawden and seconded by Commissioner Deemer to amend #16 to read <br />"That IPS proposes that the receiving of materials would be 7:00 a.m. - 5:00 p.m., Monday <br />through Friday, and 7:00 a.m. - 1:00 p.m. on Saturdays." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, LaDue and Terry. Voting No: Commissioner Thorud. <br /> <br />It was the consensus of the Commission that #17 through #27 would remain as presented. <br /> <br />Motion by commissioner Holland and seconded by Commissioner Terry to amend #28 to read <br />"That the propc!~seduse will not be unduly dangerous or otherwise detrimental to persons residing <br />or working in t~e vicinity of the use or to the public weffare." <br /> <br />Motion carded; Voting Yes: Chairperson Bawden, Commissioners Holland, Terry, Deemer, <br />Hendriksen, LaDue and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Thorud to amend #29 to read <br />"That the propOsed use will not adversely impair the use, enjoyment or market value of any <br />surrounding property." <br /> <br />Further Discussion: Commissioner Hendriksen stated that for years having a dump in the <br />community has hadia detrimental affect on the market value of surrounding property, and he feels <br />that this is not ~much of an improvement and will continue to have an adverse effect on property <br />values in this area. <br /> <br />Motion carried.: Voting Yes: Chairperson Bawden, Commissioners Holland, Thorud, Deemer, <br />LaDue, and TetXy. Voting No: Commissioner Hendriksen. <br /> <br />Motion by Core, missioner Terry and seconded by Commissioner Holland to amend #30 to read <br />"That the propgsed use will be designed, constructed, operated and maintained so as to be <br />harmonious and!~ appropriate in appearance with the existing or intended character of the general <br />vicinity and such use will not change the essential character of that area. <br /> <br />Planning and Zoning Commission/December 7, 1993 <br /> <br />i Page 3 of 8 <br /> <br /> <br />
