2) Request for a variance to front yard setback; case of Steven and Lauri Pfeiffer. <br /> <br />Chairperson Hendriksen called the special Board of Adjustment meeting back to order at 7:36 p.m. <br /> <br />BOARD BUSINESS <br /> <br />Case #1: Request for a Variance to Front Yard Setback; Case of Mike and <br /> Karen Segar <br /> <br />Zoning Admilaistrator Frolik stated the applicants' home and attached garage were constructed prior <br />to the establishment of the 110 foot thoroughfare setback requirement, at a location that is <br />approximately 98 feet from the centerline of C.S.A.H.#27, and is, therefore, considered lawful <br />noneonfomflfig. She explained the applicants are proposing to construct a 14'x23' addition to their <br />existing attached garage, which requires a variance to City Code to expand the nonconforming use. <br /> <br />Board Member Bawden suggested the City review the accessory structure setback ordinance due to <br />the increase in requests for variance. <br /> <br />Board Member Deemer stated the original intent of the ordinance was to require an 88 foot <br />structure setback from the centerlhae, and that it has now been expanded to 110 feet. He agreed <br />that the ordinance should be looked at along with the side setback ordinance. <br /> <br />Ms. Frolik noted receipt of a letter dated June 16, 1993 from Dennis Tennison, 1691 County <br />County Road440, Bovey, Minnesota 55709 (owns PIN 01-32-25-11-0012), stating no objection <br />to the request for variance. <br /> <br />The Board reviewed the findings of fact. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Deemer to amend #15 through <br />#17 in the affirmative and adopt Resolution g93-06-126 adopting amended Findings of Fact g0340 <br />relating to Michael and Karen Segar's request for a variance to thoroughfare setback requirements <br />at 4911 179th Lane N.W. <br /> <br />Further Discussion: Board Member Deemer noted that the square footage did not exceed 10% of <br />the lot. <br /> <br />Amendment by Board Member Deemer and seconded by Board Member Holland to add a finding <br />to read "That the applied for use is not an expansion of the need for public services on the <br />property." <br /> <br />Amendmentoarried. Voting Yes: Chairperson Hendriksen, Board Members Deemer, Holland, <br />Bawden, LaI~e and Thorud. Voting No: None. Absent: Board Member Terry. <br /> <br />Motion carfi~ed. Absent: Board Member Terry. <br /> <br />The Board proce~ed to review the terms of the variance. <br /> <br />Motion by Board Member Deemer and seconded by Board Member Thorud to add a term to read <br />"That a waiver of the requirement for a certificate of survey is granted by reason that the accessory <br />structure is attached to the existing principal structure." <br /> <br />Motion carried.
