the owner or operator, or if there is fail,ur[ to agree within ten days after written notice by
<br />the City to the owner or operator to make such investigation and tests, by such
<br />independent testing organization as may be selected by the Council. The costs incurred
<br />in having such gnvestigations or tests conducted shall be borne entirely by the owner or
<br />operator. The procedure stated above shall not preclude the City from taking any such
<br />other tests and investigations it finds appropriate to determine compliance with these
<br />performance standards.
