! <br />! <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Case #10: Adopt Ordinance to Amend Chapter 9 of the Ramsey City <br /> Code, Sections 9.02, 9.21.23, 9.50.37, 9.50.50 and Section <br /> 9.50.57 <br /> <br />Zoning Administrator Frolik stated that the ordinance amending Chapter 9 of the Ramsey <br />City Code was introduced on December 22, 1992. The proposed changes deal with <br />definiti6ns, the B-3 Highway Business District, and park dedication. The proposed <br />amendment to the B-3 District would make a 'conditional use' a 'permitted use'. The <br />proposed amendments to the definitions section would eliminate the opportunity to include <br />road right, of, way in order to achieve minimum lot area at the time of platting and include a <br />definition of parcel. Because of concerns expressed by Councilmembers Beyer and <br />Zimmerlnan, this proposed amendment evolved into a discussion regarding whether or not <br />road right-of-way should be taken into consideration when a property at less than 2.5 acres <br />applies for a metal accessory structure. This matter has been forwarded to the Planning and <br />Zoning Commission for further review. The proposed amendments to those sections <br />dealing ,with subdivision design standards and park dedication basically require the <br />developors to not only dedicate land for parks and trails to satisfy park dedication <br />requirements, but also to install the improvements. It also proposes that park dedication <br />will be ~tablished by City Council resolution. Ms. Frolik stated that Council could adopt <br />this ordinance with or without the definition changes. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Peterson to adopt <br />Ordinance 4/93-01 amending Chapter 9, Sections 9.02, 9.21.23, 9.50.37, 9.50.50 and <br />9.50.57. <br /> <br />Further discussion: Councilmembers Beyer and Zimmerman felt that their concerns had <br />not been addressed with regard to the definitions of lot size. Ms. Frolik stated that the <br />Planning and Zoning Commission will be discussing this issue on their next agenda. Mr. <br />Schroedgr stated that this ordinance can be passed without the definitions. The definitions <br />clean up additional issues, but are not major items. It deals with platting in the rural district <br />and we'r~ not platting in the rural district right now. It also deals with code enforcement <br />efforts. If this part is eliminated, we are not worse off; we just don't have a basis for code <br />enforcement. Councilmember Peterson inquired of Councilmember Beyer what her <br />disagreement was with the definitions. Councilmember Beyer replied that lot area says it <br />will be exclusive of the right-of-way. Councilmember Peterson stated that two <br />Councilmembers opposed it just because it doesn't include the right-of-way. Ms. Frolik <br />stated that.including road right-of-way directly conflicts with legal property description. <br />Councilmcmbgr Zimmerman stated it's been working for years. Councilmember Beyer <br />stated that when someone comes in for an accessory building, that's when it changes and it <br />is unfair for it to be calculated differently. Mayor Gilbertson agreed it was unfair, but you <br />have to make the system work. Mr. Schroeder stated that Staff is recommending <br />eliminating the definitions section at this time. <br /> <br />Councilmember Hardin withdrew his motion. Councilmember Peterson withdrew his <br />second. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Ordinances//93-01, amending Chapter 9, Sections 9.02, 9.21.23, 9.50.37, 9.50.50 and <br />9.50.57 mith the deletion of the definitions for "Lot minimum area of" and "Parcel". <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Beyer, <br />Hardin and Peterson. Voting No: None. <br /> <br />City Council/January 26, 1993 <br /> Page 9 of 11 <br /> <br /> <br />
