Voting No: None. <br /> <br />Case <br /> <br />Request to Amend the Zoning District Boundaries in the Plat of <br />Rivenwick; Case of Faye Construction <br /> <br />Zoning Afl. ministrator Frolik sated that Staff is recommending that the B-3 District be <br />retained adjacent to Highway #10 and that there be a B-1 buffer between the B-3 and the <br />R1 to the ~outh. The applicant has requested he be given all B-3 zoning as there are more <br />uses ,un~ that district. The Planning and Zoning Commission conducted a public hearing <br />and they '.are recommending approval of the amendment to the zoning distribute boundaries <br />with the inclusion of the B-1 Business District. <br /> <br />Motion byCouncilmember Zimmerman and seconded by Councilmember Beyer to rescind <br />Findings[of F~t ~)1-04-085 and adopt Resolution ~)3-02-024 adopting Findings of Fact <br />g0330 relating to a request to amend the zoning district boundaries in Rivenwiek (aka Faye <br />2nd Addition). <br /> <br />Motion carried. Voting No: None. <br /> <br />Motion bY Councilmember Zimmerman and seconded by Councilmember Beyer to <br />introduce the ordinance to amend the zoning district boundaries in the plat of Rivenwick. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case 07: Request for Preliminary Plat Approval of River's Bend 3rd <br /> Addition; Case of Elizabeth Raudio and Rick Foster <br /> <br />ZoningAdministrator Frolik stated that the River's Bend 3rd Addition plat now proposes <br />eight eomAnereial lots and 32 single family lots; the previous proposal for multi-family units <br />has been/~liminated. There are three issues to deal with prior to approval which are as <br />follows: a) Xkimo Street N.W. being constructed with a 60/66/80 foot right-of-way; b) <br />Inclusion/elimination of 143rd Avenue N.W.; and e) City participation/non-participation <br />in the cost of the public improvements. The Council's decision on whether the City will <br />participate in the financing of this development may affect the Developer's decision to <br />proceed further, <br /> <br />City En .gineer Jankowsld stated that even though the City would prefer an 80 foot right-of- <br />way, Xldmo Street N.W. could be constructed with a 66 foot fight-of-way and the eventual <br />constructiOn of 143rd Avenue N.W. <br /> <br />Mr. Rick Foster stated he would prefer the 66 foot right-of-way. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Peterson that <br />Xldmo street N.W. be constructed with a 70 foot right-of-way. <br /> <br />Motion oarried.
