He stated he met with the <br />affected residents and they have decided to petition against the project. <br /> <br />Mayor Oi!bertson closed the regular City Council meeting at 7:15 p.m. in order to conduct <br />the following public hearing: <br /> <br />1) <br /> <br />Extension of sanitary sewer and watermain improvement to 150th Lane N.W. and <br />Helium Street N.W.; Improvement Project #92-22 <br /> <br />Mayor CJilbertson called the regular City Council meeting back to order at 7:16 p.m. <br /> <br />Case g2: Status of Barthold Hog Farm <br /> <br />City Attorney Goodrich stated that since March 1, 1993, the City has received complaints <br />from seven individuals conceming the odor from the hog farm. Mr. Goodrich visited the <br />farm 10 days prior to this meeting and Mr. Barthold has closed off two pens on the west <br />side and there are 300 pigs in pens closer to Highway g47 that are at the age for marketing. <br />Mr. Barthold has stated he will not be moving in more pigs. Mr. Barthold assured Mr. <br />Goodrich all the pigs will be gone by August 1, 1993. He will be down to 200 pigs by <br />June 1,100 by July 1, and zero by August 1. He has asked for an extra 15 days to take <br />out the smaller pigs that may be left. It will be necessary to spread the manure so the smell <br />may remain awhile. Mr. Goodrich stated that Mr. Barthold has agreed to commit to a $100 <br />per day charge for any pigs there on or after August 15, 1993. <br /> <br />Motion by Councilmember Hardin and seconded by Mayor Gilbertson to reword language <br />in the agreement with Mr. Barthold stating that he can not start up any more hog operations <br />and that the redraft of this agreement be presented to Mr. Barthold. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Hardin, Beyer, Peterson <br />and Zimmerman. Voting No: None. <br /> <br />Case #3: <br /> <br />Request for Final Plat Approval of Sunny Ponds 2nd Addition; <br />Case of Jack Menkveld, North Suburban Development, Inc. <br /> <br />City Engineer Jankowski stated that Mr. Jack Menkveld is requesting final plat approval of <br />Sunny P~mds 2nd Addition. This second phase consists of 11 lots. All the lots meet the <br />minimum dimension and area requirements. Prior to releasing the plat for recording, <br />engineering plans for street and utility improvements shall be submitted to the City <br />Engineer ~ftr review and approval. Park dedication will consist of a cash payment with a <br />38% credit given for land dedicated in the first phase of Sunny Ponds. Mr. Jankowski <br />stated that the Development Agreement states that no building permit for any lot in the Plat <br />shall be issued until vehicular access is provided, etc. Mr. Menkveld has asked that this be <br />reworded to read that no certificate of occupancy be issued until vehicular access is <br />provided, etc. <br /> <br />Consensus of the Council was that the Development Agreement should be amended to <br />reflect Mr. Menkveld's request. <br /> <br />Motion bY Councilmember Peterson and seconded by Councilmember Hardin to adopt <br />Resolution ~93-04-054 granting final plat approval to Sunny Ponds 2nd Addition <br />contingent upon compliance with City Staff review letter dated April 7, 1993. <br /> <br />Motion carried.
