Motion b}, Councilmember Zimmerman and seconded by Councilmember Peterson to adopt <br />Resoluti6~ g93-p7-150 approving the final plat of Sharon Lee Addition contingent upon the <br />developer entering into a Development Agreement with the City that requires payment of <br />sewer and water connection fees pursuant to Council policy on both of the lots in the plat. <br /> <br />Further discussion: Councilmember Beyer inquired if the amount for each of the trunk and <br />lateral be~nefits could be paid out over a period of years. Mr. Rick explained they would <br />have to pay the $25,000 up front before the plat could be recorded and the lots could be <br />sold and lie has a problem with that. He stated he does not have a problem paying his fair <br />share. He stated they want to work something out if Council wants to work something <br />out. Councilmember Beyer stated she was under the impression that the Council~City <br />could work with the people. Mr. Schroeder stated he would defer to the opinion of the <br />Finance #ffleer as to if financing terms for the connection are in compliance with Council's <br />policy. <br /> <br />Motion carried. Absent: Councilmember Hardin. <br /> <br />Case #5:~ Request for Final Plat Approval of Chestnut Woods; Case of <br /> John Peters#n, Good Value Homes <br /> <br />Zoning Administrator Frolik stated that Mr. John Peterson is requesting final plat approval <br />of a minot~ subdivision to replat Lot 4, Block 2, Chestnut Hill into two lots. The lot to be <br />subdivided is one of the lots located on the private peninsula in Chestnut Hill. Although <br />the lot to I~e subdivided is located on a private road, the new lot created would be required <br />to access Eotassium Street N.W. Ms. Frolik explained that all lots will meet the minimum <br />square foot area requirements and that there is no lateral sewer and water service to the new <br />lot. The developer will provide for water and sewer improvements as a private <br />development project with no financial participation on the part of the City. Park dedication <br />will consis~ of a cash payment in the amount of $620 for the new lot created. She stated <br />that Staff f~ recommending approval of the sketch plan contingent upon the Developer <br />providing the standard five foot wide drainage and utility easement on the common <br />property line. <br /> <br />Mayor (}ilbertson inquired of Mr. Peterson if he is comfortable with Staffs <br />recommendation to which he replied he is. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />Resolution!#93-07-151 to approve the Final Plat for Chestnut Woods contingent upon <br />providing afdrainage and utility easement on the common property line between Lots 1 and <br />2 and the Developer entering into a development agreement with the City. <br /> <br />Motion carried. Absent: Councilmember Hardin. <br /> <br /> Case #6: Adopt Proposed Ordinance Vacating a Portion <br /> N.W..and Drainage and Utility Easements in <br />I Addition <br /> <br />of 148th Lane <br />Sunny Ponds <br /> <br />City Administrator Schroeder stated that the developer of Ramsey Commons 2nd Addition <br />has requeS ~.ted the City vacate a portion of 148th Lane N.W. and drainage and utility <br />easements that were dedicated in Sunny Ponds Addition. The street will be realigned to <br />allow for connection with the street in Ramsey Commons 2nd Addition.
