Case ~F~: Request for a Conditional Use Permit to have a Horse on Less <br /> ~ than Three (3) Acres; Case of Carrie Olson <br /> <br />Zoning ;Administrator Frolik stated that unaware of City Code requirements regarding the <br />maintenance of horses, Carrie Olson brought a horse onto her property at 15811 Okapi <br />Street N.W. She is approximately 1/2 acre shy of the amount needed to maintain a horse. <br />The Horse Care Board and the Planning and Zoning Commission have both reviewed the <br />case and are recommending approval of Ms. Olson's request. Ms. Frolik called attention to <br />the mn-in shed being considered non-conforming also. However, because of the hardship <br />in complying with setback requirements for barns or stables due to the unique shape of the <br />parcel, ',both the Horse Care Board and the Planning and Zoning Commission are <br />recommending that the mn-in shed be allowed to remain in its present location. The <br />conditional use permit also requires the applicant to expend a reasonable effort to establish <br />tree screening along the side property lines. <br /> <br />Council proceeded to review the proposed findings of facts. <br /> <br />Mayor Gilbertson noted that a lot of the neighbors have expressed positive comments about <br />the horse. <br /> <br />Motion bY Councilmember Zimmerman and seconded by Councilmember Paterson to adopt <br />Resoluti°n/g)3-10-255 adopting Findings of Fact g0349 pertaining to Carrie Olson's <br />request tO maintain a horse at 15811 Okapi Street N.W. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Paterson <br />and Bayer. Voting No: Councilmember Hardin. <br /> <br />Mayor Cfilbcrtson stated he would like to see the mn-in shed brought into compliance if <br />someone else moves onto the property. <br /> <br />Motion by Councilmember Paterson and seconded by Councilmember Zimmerman to <br />amend the conditional use permit to reflect that if Ms. Olson rebuilds the structure or if it <br />would change ownership, it would have to be brought into compliance with City Code. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman <br />and Beyer, Voting No: Councilmember Hardin. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Bayer to approve <br />Carrie Olson's request to maintain a horse at 15811 Okapi Street N.W. and adopt <br />Resolution g93-10-256 declaring terms of conditional use permit. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Paterson, Bayer and <br />Zimmerman. Voting No: CouncflmemberHardin. <br /> <br />Case 02A: Review of Snowmobile Ordinance <br /> <br />Councilmember Peterson stated that there have been a couple of meetings with snowmobile <br />club representatives and citizens to discuss amendments to the Snowmobile Ordinance. <br /> <br />Police Chief Auspos summarized the proposed amendments about where snowmobiles can <br />be ridden.and at what age a person may operate a snowmobile. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to introduce the <br />ordinance amending the Snowmobile Ordinance. <br /> <br />City Council/October 26, 1993 <br /> Page 4 of 9 <br /> <br /> <br />
