I
I
I
I
I
I

!
I
I
I
I
I
',.

COUNCIL BUSINESS:

PUBLIC HEARING

Case #1:

Consider Revocation of Conditional Use Permit for Lots 2, 3
and 4, Block 4, Gateway North Industrial Park Plat 2; Case of
Danny's Tranny's

Zoning Administrator Frolik stated that in May 1993, Mr. Karst applied for a conditional
use pehnit to disassemble engines and transmissions and conduct wholesale activities on
Lots 2, 3 and 4 of Block 4, Gateway North Industrial Park Plat #2. The proposal included
the construction of a 12,500 square foot building to provide for an all-enclosed operation.
Mr. Karat applied for a building permit that has been ready since October 18, 1993;
however, il~cannot be released until Mr. Karst provides the $46,680 financial guarantee for
site improvements called for in the Site Plan Development Permit. Ms. Frolik stated that
Mr. Karat!s: amended conditional use permit for Lot 1 and new conditional use permit for
Lots 2, 3 and 4, seriously hinged on whether or not he brought Lot 1 into compliance with
his current 'CUP and cleaned up Lots 2, 3 and 4. He put forth the effort and received his
approvals. Since that time, he has resumed methods of operation that are violations of this
CUP and allowed the condition of the premises on Lots 2, 3 and 4 to again decline to a
totally unacceptable level. Ms. Frolik stated a drive-by inspection was done on December
6, 1993, and it was apparent that clean-up efforts have been initiated; however, Lots 2, 3,
and 4 were not totally cleared of debris, inoperable vehicles and feedstock preparation
activity. She stated that this public hearing has been scheduled to take public comment in
the event City Council chooses to revoke Mr. Karst's permit.

Mayor Gilbertson closed the regular portion of the City Council meeting at 7:20 p.m. in
order to conduct the public hearing.

Mayor Gilbertson called the regular portion of the City Council meeting back to order at
7:34 p.m.

Motion by Councilmember Beyer and seconded by Councilmember Peterson to direct Staff
to draft a findings of fact for Council's consideration that would support the revocation of
the conditional use permit issued to Danny's Tranny's for Lots 2, 3, and 4, Gateway North
Industrial Park Plat 2.

Motion carried, Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson and
Hardin. Voting No: Councilmember Zimmerman.

Councilmomber Zimmerman agreed with what Mr. Hanson stated at the public hearing
about an industrial area being just that; not a nursery.

NEW BtlSlNES$

Case #2: Adopt 1994 Tax Levy and General Fund Operating Budget

Finance Officer Hart stated that the 1994 Truth-in-Taxation public hearing was held on
Wednesday, December 1, 1993 at 7:00 p.m. and now Council is required to adopt the levy
and budget.

Councilmember Hardin stated he is not real happy with the overall rate increase and added
that a good job had been done in the past to keep the levy down.

City Council/December 14, 1993
