<br />Public Works Director Olson stated that the language is for clay or whatever type of material an <br />engineer deems to be reasonable, which would include a liner. <br /> <br />Chair Elvig asked what recourse the City has, beyond the 12 month warranties, for this type of <br />problem. He stated that he feels is could fall under the heading of erosion control. <br /> <br />Public Works Director Olson stated that he did not think this would be considered erosion <br />control and noted that it is beyond the 12 month warranty period. He stated that there are ways <br />of potentially fixing the problem without finding the actual location of the breach. He stated that <br />polymer and bentonite can use used at a cost of about $3,000 to $5,000. <br /> <br />Chair Elvig stated that he feels the pond needs to be drained down and take a look at the liner to <br />. see what can be found. <br /> <br />Public Works Director Olson stated that it will be a very expensive process to dewater the entire <br />pond. He stated that the City would need to figure out what it would do once the problem is <br />found and who will pay for it. He stated that he thinks the breach can be fixed with bentonite <br />without dewatering the pond. <br /> <br />City Engineer Jankowski stated that the more precise the City can be about the location or <br />locations of the breach, the more the costs can be kept down. <br /> <br />Councilmember Dehen asked how confident staff is that the leak has been located. He stated <br />that he is not comfortable moving forward and doing something unless staff is absolutely sure <br />that this is the problem area and it needs to be fixed. <br /> <br />Public Works Director Olson stated that he is not confident that this location is the only leak, but <br />he is confident that there is a leak there. <br /> <br />Councilmember Olson asked whether this is something the City should be picking up the tab for <br />because this pond does not belong to the City. She stated that she does not feel the City should <br />be paying for fixing this pond. <br /> <br />Councilmember Dehen asked ifthere was a homeowner's association in the neighborhood. <br /> <br />Mr. Rothrum stated that there was not a homeowner's association. <br /> <br />Councilmember Dehen asked whether there was a consensus among the neighbors that they <br />would contribute financially to finding the source of the leak and using bentonite to fix the issue. <br /> <br />Mr. Rothrum stated that the neighborhood group has not discussed this. He stated that he feels <br />the damage was done in 2003. He reviewed aerial photos and surveys that he has gathered. <br /> <br />Councilmember Dehen stated that he feels it is the responsibility of the residents to present this <br />evidence to the developer for resolution. <br /> <br />Public Works Committee /October 16, 2007 <br />Page 7 of 12 <br />
