This will <br />be focused at the spectators and away from the residential areas. <br />The Owner will construct another berm 8 feet tall on the west side of the event area (in <br />addition to the existing berms) to form a visual and audio barrier. <br />The Anoka County Parks and Recreation Committee recommends that the conditional use <br />permit amendment not be approved based on their opinion that it is an incompatible land <br />use due to noise and visual impacts on the Mississippi West Regional Park. <br />The United States Department of the Interior, National Park Service, recommends that the <br />conditional use permit amendment not be approved based on their opinion that the noise is <br />inconsistent with the broader goals for the MNRRA and that individual and cumulative <br />impacts would significantly diminish public enjoyment of the river and riverfront public <br />spaces. <br />• The noise standards have been set forth for the entire state of Minnesota in order to protect <br />human and wildlife well-being. However, sound is affected by the environment it is <br />.created in. The most accurate way to determine the noise effects of the proposed events is <br />to conduct noise monitoring following the procedures in Minnesota Rule 7030 at sensitive <br />receptor locations during an actual event at the proposed location. If the sound is above <br />the levels set out in the Rule, then it should not be allowed to continue because it .breaks <br />the Rule. An EAW is not necessary, as research into. other noise studies that have been <br />conducted in other locations will not determine the actual effects on this location. <br />Erosion and Sedimentation <br />Site grading will be necessary to prepare the site for various events. The total area to be <br />disturbed converted from softball field to the more intense recreational. use is 4 .acres, or <br />about 172,800 square feet, but the track itself will be about half of that, with the pit area <br />taking up the other half. <br />An Erosion and Sediment Control Plan and a Storm Water Pollution Prevention Program <br />(SWPPP) will be submitted and approved as part of the permitting process. MPCA Best <br />Management Practices (BMP) will be implemented to mitigate erosion and sediment, <br />which are required for all land disturbances. Grading will be limited to the event area and <br />construction of the berm. During grading, possible BMPs to be implemented include silt <br />fences, storm water basins, rock construction entrances; and seeding disturbed slopes, and <br />will be implemented as soon as possible. The Owner will wet and groom the dirt track to <br />prevent airborne dust. Appropriate grading of the disturbed material will mitigate any <br />potential drainage problems. <br />• <br />Soil and Groundwater Impacts <br />-249- <br />
