Exhibit A <br />Diamonds Petition for EAW <br />December, 2007 <br />Page 7 <br />Because an increase in parking spaces is not proposed, even if all 430 parking spaces where full <br />and each vehicle brought 10 people, there would only 4,300 people. The estimated event <br />attendance is 700 people. <br />Several measures can be incorporated to mitigate the environmental impacts. The conditional use <br />permit amendment will be. in effect for one year, and will be subject to evaluation by the City <br />Council if the Owner wishes to extend it next year. A special events permit must be obtained for <br />each type of event (motocross, music events, demo derby and rodeos bull riding). An Erosion and <br />Sediment Control Plan and a Storm Water Pollution Prevention Program (SWPPP) will be <br />submitted and approved as part of the permitting process. The Owner will construct an additional <br />berm to screen visual and noise impacts. <br />The Owner will ensure that events comply with a daytime L10 of 65 dB(A), a daytime L50 of 60 <br />dB(A), a nighttime L10 of 55 dB(A), and a nighttime L50 of 50 dB(A) at residential and park <br />areas, according to Minnesota Rule 7030.0040. Daytime is defined by Minnesota Rule 7030.0020 <br />as 7 am to 10 prn and nighttime from 10 pm to 7 am. If the events are not within the acceptable <br />sound limits as set forth, the conditional use permit amendment will not be renewed for the 2009 <br />event season. <br />The noise standards have been set forth for the entire state of Minnesota in order to protect human <br />and wildlife well-being. However, sound is affected by the environment it is created in. The most <br />accurate way to determine the noise effects of the proposed events is to conduct noise monitoring <br />following the procedures in Minnesota Rule 7030 at sensitive receptor locations during an actual <br />event at the proposed location. If the sound is above the levels set out in the Rule, then it should <br />not be allowed to continue because it breaks the Rule. An EAW is not necessary, as research into <br />other noise studies that have been conducted in other locations will not determine the actual effects <br />on this location. Based on the above discussion, an Environmental Assessment Worksheet is <br />deemed not necessary for this project. <br />-252- <br />
