details include: estimated number of attendees, parking plans, plans for crowd control, <br />safety measures, stonnwater management measures specific to the event, level of sound <br />emissions planned, and any other issues related to public safety, health, or welfare. <br />5) Any improvements, including financial investment, the Permittee may make in reliance <br />on this IUP SHALL NOT be considered as factors by the City at such a time when the <br />Permittee applies for a permanent amended CUP, and/or extension of the IUP. <br />6) The development and operation of the outdoor recreational facilities and special event <br />uses shall be specifically limited to that described in the Permittee's site plan, submitted <br />as part of the IUP application. <br />8) The Permittee shall provide sufficient off-street parking in accordance with the approved <br />site plan and City Code performance standards. <br />9) Hours/days of operation: The Permittee shall be allowed to hold one-day events listed in <br />this above permit. on Friday or Saturday evenings or Sunday afternoons for a period no <br />longer than 4 hours each. Events held in the evenings shall be from 6-10 pm, with the <br />exception of music events, which will be permitted until 12 a.m. <br />10) A Schedule of Events (including dates and times) for all events allowed under this ItJP <br />shall be submitted to the City no later than January 31, 2008. <br />11) .Building and parking lot lighting changes are subject to the approval of the City <br />Engineer, shall be arranged to deflect light away from adjoining properties and public <br />.streets, and bulbs emitting in excess of 3,000 lumens shall be so directed that the bulb is <br />not visible from off of the Subject Property where such light source is located.. <br />12) Any outdoor Public Address system or any sound emitting from the property may not <br />exceed the noise performance standards contained in City Code, .and that, upon validated <br />complaints, such system's volume shall be reduced or the event causing the noise <br />ceased.. Speakers must be directed away from adjacent residential areas.. <br />13) Any new signage proposed for the Subject Property must meet City Code requirements. <br />14) If any provision of this IUP .shall be declared void or unenforceable, the other provision <br />shall not be affected but shall remain in full force and effect. <br />15) This IUP shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br />16) The violation of any of t material terms of this IUP is grounds for suspension or <br />revocation hereof, consistent with applicable law. Furthermore, the City specifically <br />reserves the right to amend, suspend or revoke this IUP consistent with applicable. law as <br />reasonably required to protect the public health, safety and welfare and the environment. <br />-316- <br />
