When the applicant or consumer wants to terminate his water <br />'service, he shall notify the City to turn off his water service. The <br />meter shall be read at that time to determine the final bill. <br /> <br />d. In all cases where water has been turned off for the nonpayment <br /> of bills or for violation of any rules or regulations of the City, such <br /> water shall not be again turned on unless and until such bills <br /> have been fully paid plus 10% interest, and all delinquent charges <br /> removed and a charge for turning such water on has been paid. <br /> <br />4.40.10 VARIANCES <br /> <br />The COunCil may permit variances from the strict appliance of any of the <br />provisions of this ordinance if it is satisfied that there are special <br />circumstances or conditions affecting the premises for which the variance <br />is requested and that the granting of such variance will not materially <br />affect iadversely health, safety or general welfare or public or private <br />prope~y. 'Any variation permitted under this provision must be noted on <br />the permit. A public hearing is not required. <br /> <br />4.40.1I PENALTIES <br /> <br />Any person violating any provision of this ordinance shall be guilty of a <br />gross misdemeanor and shall be punished as law provides for such offense. <br />Each clay Ithe violation continues shall constitute a separate offense. Any <br />persor~ violating any of the provision of this ordinance may also be held <br />liable to the City for any expense, loss or damage occasioned the City by <br />reason of such violation. <br /> <br />SECTION 2.~ ORDINANCE SUMMARY FOR PUBLICATION <br /> <br />The following official summary of Ordinance #92- has been approved by the <br />City Council of the City of Ramsey as clearly informing the public of the intent and <br />effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #92- to amend Section <br />4.40 of the City Code, which Section is entitled "Water and Sewer <br />Utilities'". Section 4.40 provides for setting Municipal water and <br />sewer futility rates and charges by City Council Resolution; provides <br />separate sections for each utility; changes certain procedures for <br />more efficient operation of the City's utility system and describes the <br />manner and procedures required for connecting to City water and <br />sewer '.utilities. <br /> <br />SECTION 3.' EFFE(~TIVE DATE <br /> <br />The effective date of this Ordinance is thirty (30) days after its passage and <br />publication, subject to City Charter Section 5.07. <br /> <br />Page 13 <br /> <br /> <br />
