CASE # I

PUBLIC HEARING
REQUEST FOR A HOME OCCUPATION PERMIT;
CASE OF CAREFREE HOME SERVICES, INC.
By: Amy Geisler, AICP, Interim Asst. Com. Dev. Director

Background:

The City has received an application from Michael Beach for a home occupation permit to
operate a home health care business out of his home, which is located at 7830 149th Lane NW.

The following items are enclosed for your information:

a) Site location map
b) Site layout exhibit
c) Letter from applicant
d) Proposed fIndings of fact
e) Proposed home occupation permit

Notification:

In accordance with State statute, Staff notified property owners within 350 feet of the subject
property of the public hearing.

Observations:

The Beach family has been operating Carefree Home Services out of their home since 1990.
They currently have 2 full-time office employees, and an average of 10 home health care aides
that stop by the home office weekly to collect pay checks or complete other paperwork. Michael
Beach also lives in the home.

Around 1990, Michael's parents, Jerry and LeAnn Beach, consulted City Staff when they began
the business and were told they did not need to obtain any kind of special permit. Staff has
reviewed the property fIle and did not discover any documentation related to the inquiry. It seems
plausible, though, that the Beaches were told they did not require a permit at the time, given the
small size of their operation. Over the years, however, the business has expanded to the point
where it does require a Home Occupation Permit. A complaint was made about parking at the
home, and the Beaches were informed they needed to apply for a Home Occupation Permit.

City Code restricts home occupations to 20% of the gross floor area of the home. The original
garage was converted to office space about 10 years ago, and a new garage was constructed. This
area appears to exceed this threshold. There are 3 or 4 parking spaces in front of the garage to
accommodate employee parking, and the Beaches instruct employees to only park in the

1
