There is no outdoor storage of equipment or materials, however it is fairly clear from
looking at the home that a business is being operated there.

Recommendation:

Given the number of employees (both on- and off-site), and the floor space occupied by the
business, the Beaches are technically not eligible to receive a Home Occupation Permit under
City Code. Therefore, Staff cannot recommend approval of the request. However, given the long
tenure of the business, and lack of complaints until recently, it might be appropriate for the
Planning Commission and City Council to consider an Interim Use Permit, to allow the Beaches
some time to either find an alternate site for the business, or to adjust their business practices
such that employees are no longer present at the home. Staff has included a draft Interim Use
Permit for the Planning Commission's consideration.

Commission Action:

Motion to recommend that the City Council adopt Findings of Fact relating to Michael Beach's
request for a home occupation permit.

-and-

Motion to recommend that the City Council deny Michael Beach's request for a home occupation
permit based on the Findings of Fact.

-OR-

Motion to recommend that the City Council adopt Findings of Fact relating to Michael Beach's
request for a home occupation permit.

-and-

Motion to recommend that the City Council approve an Interim Use Permit based on the
Findings of Fact.

Review Checklist:
Interim Community Development Director

PC: 1/3/08

2
