where it does require a Home Occupation Permit. A complaint was made about parking at the <br />home, and the Beaches were informed they needed to apply for a Home Occupation Permit. <br />City Code restricts home occupations to 20% of the gross floor area of the home. The original <br />garage was converted to office space about 10 years ago, and a new garage was constructed. The <br />total area of the home is 2,228 square feet, and the space used for the business is 900 square feet, <br />for a total of 39%. There are several parking spaces in front of-the garage to accommodate <br />employee parking, and the Beaches instruct employees to only park in the driveway. There is no <br />outdoor storage of equipment or materials, however it is fairly clear from looking at the home <br />that a business is being operated there. <br />The Planning Commission held a public hearing on the request at their January 3, 2008 meeting; <br />one letter was received about the request, which is included with this case. <br />Recommendation: <br />Given the number of employees (both on- and off-site), and the floor space occupied by the <br />business, the Beaches are technically not eligible to receive a Home Occupation Permit under <br />City Code. Therefore, Staff recommended to the Planning Commission that the Permit be denied. <br />However, Staff also noted that given the long tenure of the business, it might be appropriate for <br />the Planning Commission and City Council to consider an Interim Use Permit, to allow the <br />Beaches some time to either find an alternate site for the business, or to adjust their business <br />practices such that employees are no longer present at the home.
