CASE # <br />• PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO PLATTING REQUIREMENTS <br />TO ALLOW A METES AND BOUNDS SUBDIVISION; <br />CASE OF GERALD BAUER <br />By: Sylvia Frolik, Interim Community Development Director <br />Background: <br />Gerald Bauer owns a 34.72 acre parcel at the northwest quadrant of Variolite Street and 161" <br />Avenue N.W. Mr. Bauer has drawn up deeds to donate the land to the Church of Saint Katharine <br />Drexel over a two year period (2007/2008). Conveyance of the land in a two year period -requires <br />subdividing the property into 2 lots. Mr. Bauer has committed to donate 25 acres to the Church <br />for 2007 and 9.72 acres in 2008. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Proposed lot exhibit <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br />• Notification: <br />A public hearing regarding the request for variance from platting procedures was published in the <br />Anoka County Union. <br />Funding Source: <br />All staff costs incurred in processing the application are paid for by the applicant. <br />Observations: <br />Section 9.50 (Subdivision) of City Code requires platting for the subdivision of property. <br />Section 9.50.06 of City Code (Procedural Variances) establishes a process to grant a variance to <br />platting requirements, when strict compliance with these requirements may cause a practical <br />difficulty or undue hardship, provided the variance does not affect the spirit and intent of the <br />Section. <br />The applicant has stated that requiring platting in order to convey the 34 acres as a 25 acre lot <br />and a 9 acre lot to the Church over a 2 year time frame does present a practical difficulty. Had <br />the conveyance been planned as a 34 acre donation in a 1 year time frame, there would have been <br />no review required by the City. <br />_231_ <br />
