• <br />• <br />Councilmember introduced the following resolution and moved for its adoption: <br />`RESOLUTION #08-02-_ <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE <br />PLATTING REQUIREMENTS IN CITY CODE TO APPROVE A CONVEYANCE OF <br />LAND BY METES AND BOUNDS DESCRIPTION AND DECLARING TERMS OF <br />SAME. <br />WHEREAS, Gerald J. Bauer and Heidi A. Bauer, (Permittee), have properly applied for <br />a Variance to platting requirements established in Section 9.50 (Subdivision) of the Ramsey City <br />Code to facilitate a conveyance of land by metes and bounds description to the Church of Saint <br />Katharine Drexel ("Church"). <br />WHEREAS, the City Council (acting as the Board of Appeal) met on February 12, 2008, <br />conducted a public hearing and adopted Findings of Fact 40_ relating to the request for a <br />variance from platting requirements to facilitate a metes and bounds subdivision and conveyance. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. The requirements of City Code Section 9.50 (Subdivision) are a practical difficulty in that <br />the property to be conveyed is significant in size and is proposed to be developed by the <br />Church. <br />2. Based on Findings of Fact #0_, a variance to the platting requirements in City Code <br />Section 9.50 (Subdivision), is hereby granted to Gerald J. Bauer and Heidi A. Bauer for <br />the parcels shown in Exhibit A — Proposed Parcel A and Exhibit A — Proposed Parcel B, <br />all prepared by Passe Engineering as Dwg. 530-07. <br />3. The City Council hereby approves the metes and bounds subdivision as shown in Exhibit <br />A, subject to the following conditions: <br />a) At the time the deeds are recorded at Anoka County, a lot combination shall be <br />done to assign one County Parcel Identification Number to the two parcels. <br />b) That any fixrther subdivision of the Subject Property shall be in accordance with <br />Section 9.50 (Subdivision) of the Ramsey City Code. <br />C) That the terms of this Variance shall be binding upon the Subject Property's <br />successors and assigns. <br />4. This Variance shall automatically become null and void if it is not initiated within twelve <br />(12) months of the date of approval, unless an extension is granted at the written request <br />• of the Permittee. <br />-237- <br />
