Staff Recommendation: <br />Staff recommends not waiving the statutory tort limits and declining the optional excess liability coverage due to <br />the cost of the excess liability coverage and the potential for excessive claims and /or awards with an increased <br />level of liability coverage. <br />Council Action: <br />Direct staff to decline optional excess liability coverage OR direct staff to purchase optional excess liability <br />coverage. If the direction is to purchase optional excess liability coverage, direct staff with regard to amount of <br />additional coverage and to waive or not -waive the statutory tort limits to limit the amount recovered by an <br />individual. A resolution regarding waiving or not - waiving the statutory tort limits is attached if adoption is <br />needed to waive the statutory tort limits.
