<br />SECTION 4. PROHIBITION <br /> <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Towers", <br />no Conditional Use Permit (CUP) will be granted to construct a cell tower within the City and no <br />applications for said construction shall be accepted, except for those identified in Sections 5 and 6 <br />below. <br /> <br />SECTION 5. EXCLUSIONS <br /> <br />The following within the City are excluded from this Interim Ordinance: <br /> <br />1. Antennas mounted on existing towers and structures <br /> <br />2. Antennas not requiring a Conditional Use Permit as stated in Chapter 9.15.17 of City Code <br />entitled' Antennas Designed for Private Reception of Television and Radio Signals.' <br /> <br />SECTION 6. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, <br />undue hardship may result form strict compliance. In granting an exception, the City Council shall <br />prescribe any conditions that it deems necessary to or desirable for the protection of the public <br />interest. NO exception shall be granted unless the City Council finds: <br /> <br />1. That there are special circumstances or conditions affecting said property such that <br />the strict application of the provisions of this Interim Ordinance would deprive the <br />petitioner of the reasonable use ofpetitioner's land. <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />3. That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />4. That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and will not adversely <br />affect the planning process for adoption of amendments to the Comprehensive Plan <br />above described. <br /> <br />5. That the proposed use/subdivision will be consistent with the intent and purpose of <br />this Ordinance. <br /> <br />SECTION 7. TERM <br /> <br />The term of this Ordinance shall be for a period of six months commencing with its effective date. <br />The term may be extended after approval by the City Council for an additional period as provided <br />for in Minnesota Statutes, Section 462.355, Subd. 4. <br /> <br />Ordinance #08-08 <br />Page 2 of3 <br />
