Case # J....

Public Hearing
REQUEST FOR AN INTERIM USE PERMIT TO ALLOW MULTIPLE
OUTDOOR SPECIAL EVENTS AT 7550 IDGHWAY 10 NW (DIAMONDS
SPORTS BAR);
CASE OF FIRST CLASS AUCTIONS & EVENTS, INC.
By: Tim Gladhill, Management Intern

Background:

First Class Auctions & Events has submitted an application for an Interim Use Permit
(IUP) to allow several outdoor special events on the seventeen-acre parcel located at
7550 Highway 10 NW (Diamonds Sports Bar and Grille). As the Planning Commission
may recall, a similar request was submitted by the owner of Diamonds Sports Bar & Grill
on the same property in late 2007. This most recent application by First Class Auctions
& Events represents a separate, less intensive set of proposed uses and events by the
current property owners. The maximum duration of an Interim Use Permit is five (5)
years from the date of approval, unless otherwise approved by the City Council.

The following items are included in your packet, for your information:

1) Site location map
2) Letter from applicant outlining request
3) Proposed site layout
4) Proposed Findings
. 5) Proposed IUP

Notification: .

Staff attempted to notify all property owners within 1,000 feet of the subject property and
the property owners in the Alpaca Estates neighborhood. This represents the same
mailing notification of Ramsey parcels as the previous request by Diamonds Sports Bar
& Grill in 2007. Staff has also notified the City Administrator's Office at the City of
Dayton.

Observations:

Although this new request is within one (1) year of the previous application, staff and the
City Attorney have determined that the application varies enough from the previous
request that this new IUP Application can be considered by the Planning Commission
and City Council.

The special events are proposed to include:

a. Small scale events including Farmer's Markets, Flea Markets, Car Shows, and
family- friendly events (up to twenty (20) per swnmer)

13
