<br />4) An annual review by the City Council will be conducted to analyze the compliance with <br />the terms of the IUP. <br /> <br />5) All events must be conducted within the softball fields as shown on the Site Layout <br /> <br />6) The Permittee will meet with City Staff tq review all event details no less than two weeks <br />prior to each event. The applicant will not be exempt from state, county, and local <br />permits, excluding the City of Ramsey Special Events Permit <br /> <br />7) Any improvements, including financial investment, the Permittee may make in reliance <br />on this !up. SHALL NOT be considered as factors by the City at such a time when the <br />Permittee applies for an extension of the !UP. <br /> <br />8) The development and operation of the special event uses shall be specifically limited to <br />that described in the Permittee's site plan, submitted as part of the TUP application. <br /> <br />9) The Permittee shall provide sufficient off-street parking in accordance with the approved <br />site plan and City Code performance standards. <br /> <br />10) A Schedule of Events (including dates and times) for all events allowed under this IUP <br />shall be submitted to the City no later than May 1,2008. <br /> <br />11) Building atld parking lot lighting changes are subject to the approval of the City Engineer, <br />shall be arranged to deflect light away from adjoining properties and public streets, and <br />bulbs emitting in excess of 3,000 lumens shall be so directed that the bulb is not visible <br />from off of the Subject Property where such light source is located. <br /> <br />12) Any outdoor Public Address system or any sound emitting from the property may not <br />exceed the noise performance standards contained in City Code, and that, upon validated <br />complaints, such system's volume shall be reduced or the event causing the noise ceased. <br />Speakers must be directed away from adjacent residential areas. <br /> <br />13) Any new signage proposed for the Subject Property must meet City Code requirements. <br /> <br />. 14) If any provision of this IUP shall be declared void or unenforceable, the other provision <br />shall not be affected but shall remain in full force and effect. <br /> <br />15) This IUP shall not be considered modified, altered, changed or amenq.ed in any respect <br />unless in writing and signed by the City and the Permittee. <br /> <br />16) The violation of any of the material terms of this IUP is grounds for suspension or <br />revocation hereof, consistent with applicable law. Furthermore, the City specifically <br />reserves the right to amend, suspend or revoke this IUP consistent with applicable law as <br />reasonably required to protect the public health, safety and welfare and the environment. <br />Specifically, but without limiting the foregoing, the City may amend, suspend or revoke <br />this IUP consistent with applicable law if the City Council reasonably determines that <br />continued operation of the one-day events places the public health, safety, or welfare, or <br /> <br />22 <br />
