City Attorney Goodrich reviewed that Council has authorized the sale of the property at 14050
Basalt Street to Ace Solid Waste, Inc. It has come to staff's attention that two previous
conditional use permits were issued for this property; one to Danny's Aluminum Ptocessing, Inc.
in 1989 and one to Saint Paul Terminals; Inc. in 2001. The title company requires that the City
formally state that these two conditional use permits have been cancelled in order for the City to
convey marketable title. Mr. Goodrich stated staff has researched both conditional use permits
and recommends adoption of a motion to cancel the conditional use permits.

Motion by Councilmember Elvig, seconded by Councihnember Look, to formally cancel the
following:
1) That certain Conditional use Permit issued to Danny's Aluminum Processing, Inc. dated
April 29, 198.9 for Lot 1, Block 4, GATEWAY NORTH INDUSTRIAL PARK PLAT 2;
2) That certain Conditional Use Permit issued to Saint Paul Terminals, Inc. dated June 26,
2001 for Lot 1, Block 4, GATEWAY-NORTH INDUSTRIAL PARK PLAT 2,

AND

The Mayor and City Administrator are directed to execute on behalf of the City respective
Notice of Cancellation documents notifying the County Recorder that said Conditional Use
Permits have been cancelled.

Motion carried.
