All licensees <br />must make an appointment with the Police Department, after the license is approved by <br />Council. but prior to conductin!! business. to have a photo taken or an identification bad!!e <br />to be issued. Such bad!!e must be worn or conspicuously displaved whenever business is <br />bein!! conducted. <br /> <br />7.85.09 Non-Issue/Denial. If asa result of a back!!round investi!!ation. the applicant <br />is found to be unsatisfactory. the Chief of Police shall endorse on such application his or <br />her disapDroval and the reasons for the same. and return the aDDlication to the City Clerk. <br />who will in turn brin!! the request with recommendation for denial to the City Council. <br />The Police Chiefmust comDlv with the Drovisions of Minnesota Statute Chapter 364 if the <br />recommendation for denial is based in whole or in Dart uDon Drior criminal convictions. If <br />the Council denies the issuance of a license. the City Clerk shall notify the aDPlicant that <br />hislher aDDlication is disaDDroved and no Dermit shall be issued. <br /> <br />Any aDDlicant may be found to be unsatisfactory for reasons includin!!. but not solely <br />limited to: <br /> <br />a. Fraud. misreDresentation or incorrect statement contained in the aPDlication <br />for Dermit. <br />b. Past fraud. misreDresentation or incorrect statement made in the course of <br />carryin!! on a business as a solicitor. canvasser. Deddler. transient merchant. <br />itinerant merchant. or itinerant vendor. <br />c. Past conviction of anv crime or misdemeanor involvin!! fraud. theft or moral <br />turDitude. or anv crime of violence as defined in Minnesota Statute 624.713; <br />d. Conductin!! the business of peddler. solicitor. transient merchant. itinerant <br />merchant. or itinerant vendor, as the case may have been. in an unlawful <br />manner or in such a manner as to constitute a breach of peace or to <br />constitute a menace to health. safety or !!eneral welfare of the Dublic. <br /> <br />7.85.10 Revocation. Any license may be revoked by the Council for a violation of any <br />provision of this City Code if licensee has been given a reasonable notice (define reasonable??) <br />and an opportunity to be heard. <br /> <br />7.85.11 ApDeal. Any Derson a!!!!rieved by the denial/revocation of a license. may <br />aD peal to the City Council. Such aPDeal shall be taken by filin!! with the City Clerk. within <br />fourteen (14) davs after notice of the action comDlained of. a written statement settin!! forth <br />fullv the !!rounds for the appeal. The City Clerk shall schedule a time and place with the <br />City Council for hearin!! on such aDDeal. and notice of such hearin!! shall be !!iven to the <br />aDDlicant. No individual may conduct anv business while an appeal is Dendin!!.
