Commissioner Brauer arrived at 7:10 p.m. <br /> <br />Citizen Input <br /> <br />Mr. Michael Beach stated as explained in the letter, when the business started, eighteen to twenty <br />years ago his father did not know they needed to have an occupational permit if there were to be <br />outside employees in the home. He stated as the business has grown, they have currently two full <br />time employees that do not live at the home and have since built attached offices and they did not <br />know it could not exceed twenty percent of the home. He stated they would like to come to some <br />type of solution because they would like to keep the business going there. He stated they would <br />be willing to modify the way they do business if needed. He stated they do have ample parking <br />in their driveway. He stated he has not previously heard of problems with their septic system and <br />they get it pumped every two years and has always worked fine. <br /> <br />Mr. Jerry Beach stated he wrote a letter to the City with his feelings about a request for a permit <br />and the reasons why he felt it should be allowed. They have never been a concern to the <br />community, they have never had any problem being there ~nd he has always tried to control the <br />growth of their business. He stated where they are at now is where he plans to stay at in regards <br />to growth. He stated they do not want to grow to a point where they have more than they can <br />handle. It will not be any worse than what it is. Their desire is to be able to maintain their <br />business on site and they could adjust the twenty percent to be within that in regards to the <br />building. He stated he did not foresee any more employees than what they have and they are <br />asking for this permit to be granted. <br /> <br />Commissioner VanScoy stated regarding the statement about a home occupation not requiring a <br />permit, he asked for clarification. <br /> <br />Assistant Community Development Director Frolik stated at the time they first came to the City, <br />if the residents of the home were operating a business and there were not any non-resident <br />employees, they did not need a home occupation permit. Since then the City has solidified that <br />policy in City Code and have added another feature where you can only have non-resident <br />employees in the business if the parcel is at least three acres in size and the business is carried on <br />elsewhere and not in the home, such as a garage or outside building. They do not have three <br />acres and they have outside employees. <br /> <br />Commissioner VanScoy stated there is a statement in the findings of fact that home health care <br />businesses are not permitted in a residential zone. <br /> <br />Assistant Community Development Director Frolik stated that was correct, unless they get a <br />home occupation permit and they can only get a home occupation permit if there are no outside <br />employees. She stated the only thing permitted in an R-l District is a dwelling and parks. <br /> <br />Commissioner Van Scoy wondered if there were figures regarding the business exceeding twenty <br />percent of the home. <br />Assistant Community Development Director Frolik did not think they were provided by the <br />applicant.
