<br />Mr. Jerry Beach reviewed the dimensions with the Commission and he stated they could adjust <br />this to make it work within the twenty percent of the home. <br /> <br />Assistant Community Development Director Frolik thought it looked like they were at forty <br />percent of the home and even if they reduce the office size they still have the issue of having non- <br />resident employees. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Trites Rolle, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Trites Rolle, Brauer, Cleveland, <br />Hunt, Levine, and Van Scoy. Voting No: None. Absent: None. <br /> <br />The public hearing closed at 7:23 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning" Commission back to order at 7 :23 <br />p.m. <br /> <br />Chairperson Nixt wondered if the Commission would be amenable to a three year Interim Use <br />Permit. <br /> <br />Commissioner VanScoy stated he would support that because the business has not been an issue <br />in the past and the City was the one that changed their policy. <br /> <br />The Commission reviewed the findings of fact and made the following changes: <br /> <br />Item 5 Health Care Businesses are not a permitted use in the R -1 District without a Home <br />Occupation Permit. <br /> <br />Item 12 Amend to state what is allowed under 20% regulation compared to what is being used <br />at the site currently. <br /> <br />Motion by Commissioner Levine, seconded by Chairperson Nixt, to recommend that the City <br />Council adopt the Findings of Fact with the changes discussed. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Cleveland, <br />Hunt, Trites Rolle and Van Scoy. Voting No: None. Absent: None. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Levine, to recommend that the City <br />Council grant the Interim Use Permit based on the Findings of Fact subject to the modification <br />that they include a further condition that the area of the use not exceed that which is currently in <br />effect as disclosed by the applicant and changing the term of the permit from two to three years. <br /> <br />Planning Commission/January 3, 2008 <br />Page 4 of 8 <br />
