Absent: Trites-Rolle. <br /> <br />The public hearing closed at 8:22 p.llJ.. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:22 <br />p.m. <br /> <br />Chairperson Nixt stated the City has limits on noise ordinance but it was not necessarily crafted <br />for a public event that uses a large scale P.A. System. He explained his understanding of the <br />City's noise ordinance. <br /> <br />Chairperson Nixt stated he did not have enough information to make a formal recommendation <br />to the Council. <br /> <br />Commissioner Brauer did not know if they could ever regulate a large scale P.A. System. <br /> <br />Chairperson Nixt did not think they should allow a large scale P .A. System at this site because of <br />the surrounding neighborhood. <br /> <br />Motion by Chairperson Nixt, seconded by Cleveland, to adopt the findings of fact denying this <br />item because the applicant's request for events is vague and unspecific therefore determination <br />cannot be made. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Cleveland, Brauer, Hunt, <br />Levine, and Van Scoy. Voting No: None. Absent: Trites Tolle. <br /> <br />Motion by Chairman Nixt, seconded by Commissioner Brauer, to recommend that City Council <br />deny the request for an Interim Use Permit based on the findings of fact due primarily to <br />concerns about ambient noise caused by large events including traffic and public safety concerns <br />due to the free form nature of the applicants request and the need for the City to assure itself that <br />it has the ability to review and approve the applicants annualized event plan that it would have <br />had under the Special Event Permit parameters and a five year approval is unnecessarily long <br />given the inherent uncertainty of the nature of the events. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Cleveland, Hunt, <br />Levine, and Van Scoy. Voting No: None.
