<br />Because Ramsey is a city, nota town, PACT does not apply an admissions preference <br /> <br />based on an applicant's status as a resident of the City of Ramsey. Id., ~ 8. <br /> <br />According to PACT's enrollment policy, . class openings .are filled first by students who <br /> <br />have a Sibling or Proximity Preference and a completed application on file prior to the lottery <br /> <br />date. Id., ~ 9, Ex. A. If there are more applicants than total openings, positions are filled by the <br /> <br />random lottery method, with a random lottery of Sibling Preference and Proximity Preference <br /> <br />applicants first, followed by a random lottery process for students that do not qualify for a <br /> <br />preference. A. <br /> <br /> <br />As of February 8, 2008,156 students, including the son of plaintiff Matthew J~ Look, <br /> <br /> <br />were on the waiting list for PACT's 2008-2009 kindergarten class, which has 36 available <br /> <br /> <br />positions (18 morning kindergarten and 18 afternoon kindergarten). Id., ~ 11. Of the 156 <br /> <br /> <br />students on the waiting list, 26 are siblings of current students and thus qualify for the Sibling <br /> <br /> <br />Preference. None of the 26 siblings are residents of the City of Ramsey. Id. Of the 156 <br /> <br /> <br />kindergarten applicants, 50 are Ramsey residents (approximately 32%). Id. None of the 156 <br /> <br /> <br />waiting list students qualify for the Proximity Preference. Id. <br /> <br /> <br />If PACT proceeds pursuant to its current policy, 26 of the available seats would be given <br /> <br /> <br />to the 26 applicants who have siblings already attending PACT. Id., ~ 12. The remaining ten <br /> <br /> <br />seats would be randomly distributed through a lottery to the 130 other applicants. Id. Each <br /> <br /> <br />. applicant qualifying for the sibling preference would have a 100% admissions guarantee (since <br /> <br /> <br />the number of siblings does not exceed available openings). Id. Each non-sibling applicant, <br /> <br /> <br />such as plaintiff's son, would have an approximately 7.6% chance (10/130) to enroll in PACT's <br /> <br /> <br />kindergarten class.
