'.' <br /> <br />STATE OF MINNESOTA ) <br />) <br />COUNTYOFANOKA ) <br /> <br />Daniel DeBruyn, being first duly sworn, states as follows: <br /> <br />1. I am employed as the Administrator of Defendant PACT Charter School <br /> <br />("PACT"). <br /> <br />2. In my duties as Administrator, I am familiar with PACT's enrollment policy, its <br /> <br />lottery process, and its interpretation of the admission preference requirements imposed by <br /> <br />Minnesota Statute S 124D.1O, subd. 9. <br /> <br />3. A true and correct copy ofP ACT's enrollment policy, which was last approved in <br /> <br />November of 2007 is attached as Exhibit A. <br /> <br />4. The Minnesota Department of Education ("MDE") has been provided with and <br /> <br />reviewed PACT's enrollment policies numerous times since the school first opened its doors in <br /> <br />1994. Until the January 25,2008 MDE letter that was written in response to Senator lungbauer's <br /> <br />inquiries, MDE has never advised PACT that a preference must be applied to favor City of <br /> <br />Ramsey residents or notified PACT of any problems with its admissions. <br /> <br />2153181v5 <br /> <br />-157- <br />
