<br />5. At MDE's request, in recent years PACT has also submitted copies of the actual <br /> <br />enrollment applications for all students who have applied for admission. Most recently, this was <br /> <br />done in fall 2007 when MDE requested applications from all charter schools. Again, MDE has <br /> <br />raised no issues with those applications that would suggest that PACT was erroneous in its <br /> <br />interpretation ofM.S.A. S 124D.10's preference requirements. <br /> <br />6. In accordance with Minnesota Statute S 124D.I0, as apart of PACT's enrollment <br /> <br />policy, PACT applies a Sibling Preference and will give acceptance preference to siblings of a <br /> <br />student(s) currently enrolled and in attendance at PACT. Siblings include: 1) All children of a <br /> <br />family unit related biologically, by marriage or adoption to one or both parents. 2) All children <br /> <br />in 'long term' placement within a foster-care situation. Documentation regarding foster-care will <br /> <br />be required from a case manager, judge, or court. <br /> <br />7. Also in accordance with Minnesota Statute S 124D.10, PACT applies a Proximity <br /> <br />Preference and will give preference to a student that lives within two miles of PACT Charter <br /> <br />School's location (as the crow flies) if the next closest public school (which serves their grade <br /> <br />level) is more than five miles away from the student's home. As explained in the attached <br /> <br />enrollment policy, Exhibit A, distances are determined using the Google Earth program or <br /> <br />official Anoka County highway maps. A student qualifying for the Proximity Preference will <br /> <br />receive equal preference to that of a student qualifying for the Sibling Preference. <br /> <br />8. Because Ramsey is a city, not a town, PACT does not apply an admissions <br /> <br />preference ("Town Preference") based on an applicant's status as a resident of the City of <br /> <br />Ramsey. <br /> <br />9. According to PACT's enrollment policy, class openings are filled first by students <br /> <br />who have a Sibling or Proximity Preference and a completed application on file prior to the <br /> <br />1 2153181v5 <br />- 58- <br /> <br />2 <br />
