If plaintiffs' suggested applications process was followed, in which a Town <br /> <br /> <br />Preference for Ramsey residents was applied, and the Sibling Preference was restricted to <br /> <br /> <br />applicants withP ACT siblings. who are Ramsey residents, the entire kindergarten class would be <br /> <br /> <br />filled by 36 of the 50 Ramsey resident applicants. Under. that scenario, the class would be <br /> <br /> <br />Ramsey-resident only, plaintiffs son would have a 72% chance of admission (36/50), and a <br /> <br /> <br />sibling of a current PACT student would have no chance for admission. In addition, there is no <br /> <br /> <br />reason to believe that the reference to. sibling preference is in any way tied to the town or <br /> <br /> <br />proximity preference within Minnesota Statute S l24D.lO. <br /> <br />15. The most likely long-term consequence if PACT were required to expand the <br /> <br />Town Preference to add a preference for residents of the City of Ramsey would be that the <br /> <br />school would only be available to Ramsey residents. <br /> <br />16. Since plaintiff requests PACT's policy to be modified to bar siblings of current <br /> <br /> <br />students who are not Ramsey residents from taking advantage of the Sibling Preference, if PACT <br /> <br /> <br />is required to apply the Town Preference as Plaintiff suggests, then families with students <br /> <br /> <br />attending PACT for the 2008-09 school year in every grade will be affected, not just those <br /> <br /> <br />seeking in emoUment in kindergarten, <br /> <br /> <br />17. If the lottery were to be postponed until this interpretation is resolved, it will <br /> <br /> <br />cause undue harm to many families with students wishing to enter the kindergarten as well as 6th <br /> <br /> <br />through 12th grades for the 2008-2009 school year, since there are no other schools within the <br /> <br /> <br />Ramsey city limits that offer instruction in those grade levels.
