Absent: Board Members Nixt, Trites Rolle. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing - Request for a Variance to Construct an Accessory Building <br />Nearer the Front Property Line than the Principal Building; Case of Donald <br />Hassler <br /> <br />Chairperson VanScoy closed the regular portion of the Board of Adjustment meeting at 7:03 <br />p.m. in order to conduct the public hearing. <br /> <br />. Public Hearin2 <br /> <br />Chairperson Van Scoy called the public hearing to order at 7:03 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Geisler advised that Section 9.11.02 of the Ramsey City Code states that on <br />properties less than two acres in size, no accessory building shall be constructed nearer the front <br />property line than the principal building. Mr. Hassler has applied for a variance to construct an <br />accessory building nearer the front property line than his home on the property located at 6660 <br />13ib Avenue NW. <br /> <br />The subject property is about 0.7 acres and thus, City Code requires any detached accessory <br />building to be constructed in the side or rear yard. The property is located on the Mississippi <br />River and must also meet additional setback requir~ments related to the river overlay district. <br /> <br />The applicant's home was built in the 1930s and is approximately 75 feet from the river. An <br />existing detached garage is located between the home and 13 7th Avenue, which was damaged by <br />fire. several years ago. Mr. Hassler wishes to tear this one down and build a new garage, slightly <br />south of the existing garage but still between the house and the street, which requires a variance. <br />The existing garage is approximately 20 feet from the front property line and is considered legal <br />non-conforming. <br /> <br />When constructed, the new garage would be 162 feet from the river, 30 feet from the front <br />property line, and 10 feet from the side property line. The new garage will meet the river setback <br />requirement of 100 feet. The garage will be 676 square feet in size, also meeting the size <br />requirements of City Code. <br /> <br />The City has granted similar variances III the past, particularly III the Bowers Drive <br />neighborhood. <br /> <br />City Staff recommends approving the variance request, because the new garage will be set further <br />back from the street than the existing garage, while still meeting the required river setback. <br /> <br />Board of Adjustment/September 6,2007 <br />Page 2 of 7 <br />
