<br />Assistant Community Development Director Frolik asked if the new garage could be constructed <br />closer to the home to be more accessible to Mr. Hassler. <br /> <br />Mr. Sorino stated it cannot be with the sewer and water locations on the property. There is no <br />way they can get it any closer to the house itself. <br /> <br />Board Member Brauer wondered at what point the ADA comes into this. <br /> <br />Board Member Cleveland did not think ADA came into affect on private property. <br /> <br />The Board asked Mr. Hassler what materials the temporary structure was made from. Mr. Sorino <br />indicated the structure was purchased from Menards and is advertised for protecting cars and <br />boats. <br /> <br />Associate Planner Geisler thought the purpose was to remove the concerns about aesthetics and <br />she thought this was primarily an aesthetics thing. <br /> <br />Chairperson Van Scoy asked if they have different definitions for temporary accessory structures. <br /> <br />Assistant Community Development Director Frolik stated there are just performance standards <br />that say the accessory structures need to be made out of the same materials as the home and they <br />do not address the canvas type temporary structures, code is silent on this so it is not permitted. <br />She stated it is mostly for aesthetics and building code. <br /> <br />Board Member Brauer wondered if the applicant could file for a variance or a non-conforming <br />use. <br /> <br />Assistant Community Development Director Frolik thought it would more expeditious to put a <br />term in the code for something like this, such as a sunset clause. . <br /> <br />Mr. Sorino thought if the City could allow this for three years they could make other <br />accommodations or have the driveway covered but it would not be feasible to do the driveway at <br />the same time as building the garage. <br /> <br />Chairperson VanScoy felt temporary structures should be allowed for a period of time and the <br />Commission agreed. <br /> <br />Ms. Nora Sorino stated her father is free to come and go as he wants and she would request more <br />than three years. <br /> <br />Chairperson VanScoy stated the City is trying to accommodate them but they do not want to set <br />a precedent for the City. He thought a sunset clause of five years would be adequate. <br /> <br />Board Member Cleveland was comfortable with five years. <br /> <br />Board Member Nixt arrived at 7:23 p.m. <br /> <br />Board of Adjustment/September 6, 2007 <br />Page 4 of7 <br />
