<br />The applicant is requesting that the IUP be approved for an initial term of two (2) years. The <br />applicant has stated that the first year is necessary for development purposes and the second year <br />for more established events. Furthermore, the applicant has expressed a desire to extend the !UP <br />terms another 2-3 years depending on success of the first two years but does not foresee going <br />beyond the five-year term of an IUP. <br /> <br />Staff recommends granting the maximum period of five (5) years is more appropriate in this <br />instance due to the fact the end goal of the applicant is for the full five (5) year period of the !UP. <br />This will prevent the applicant from having to re-apply for the !UP and paying the applicant fees <br />and escrow a second time. Market conditions would determine whether the IUP realizes its full <br />five (5) year time period. <br /> <br />Although a similar request on this subject property was just recently denied, staff believes that <br />this is a less intensive use when compared to the previous request. The motocross element of the <br />request has been eliminated, drastically reducing the noise impacts to neighbors. Also, no <br />permanent structures and no significant changes to the grading of the site are being proposed, <br />minimizing the environmental impacts to the site. Staff is recommending approval of the request <br />for five (5) years, withan annual review. <br /> <br />Management Intern Gladhill noted that there was a CUP violation that occurred over the <br />weekend at Diamonds Spons Bar. He explained the violation to the Commission. <br /> <br />Commissioner VanScoy asked what issues were brought forward with the event that happened <br />and Management Intern Gladhill indicated it was a noise issue. <br /> <br />Commissioner Cleveland stated she would like to hear what the residents have to say and then <br />make a decision. <br /> <br />Citizen Input <br /> <br />Ms. Kim Westman stated only one of the people involved in Monster Auctions is involved with <br />Diamonds, the rest of the members are not involved. <br /> <br />Ms. Westman reviewed some of the events they would like to have with the Commission. <br /> <br />Chairperson Nixt asked how many of the events were they anticipating using a P A systems for <br />and Ms. Westman thought they would need to use them for the auto shows, rodeo and the <br />threshing show. <br /> <br />Mr. Chris Westman stated the only lights that would be used were the regular softball lights and <br />they are already pointed away from the residential area. He did not think there would be too <br />many events that would use lights. <br /> <br />Commissioner Cleveland stated she was still concerned with the family friendly events and she <br />wanted to know exactly what the other family friendly events would be that were not listed. <br /> <br />Planning Commission / March 6, 2008 <br />Page 5 of 21 <br />
