<br />Chairperson Dehen asked what types ofimprovements could be done for that $30,000. <br /> <br />Mr. Olson responded we do not know the cause of the leak right now so we really do not know <br />how long it will take to fix it or if that is the only leak but we should be covered with the <br />$30,000. Ifwe can get this done expeditiously, we will return any amount left over in the escrow <br />to the Developer. <br /> <br />Attorney Goodrich stated the developer should not to be out any money, we will pay the vendors <br />as costs incur. <br /> <br />Assistant City Engineer Himmer explained what had been done and what the costs have been. <br /> <br />Rick Packer with Arcon Development stated that the attorney and staff are saying that this is a <br />storm water part of the functioning system. He is not aware of any requirement placed on him <br />that says a liner will make this system function better. He thinks it's more for aesthetics. He <br />feels he owes this to the residents that we will try to fix it. Staff feels there is some risk in the <br />method we have proposed to fix it. He is not trying to be a 'jerk" but he has a hard time trying to <br />get this fixed to everyone's satisfaction. No one has told him that his method is acceptable. <br /> <br />Chairperson Dehen inquired if Mr. Packer knew the source of where it's coming from. <br /> <br />Mr. Packer stated it doesn't matter and questioned why waste time with dye when polymer will <br />fix the leak and plug it. He feels City staff is wasting time and effort on dye but he has not been <br />told that what he wants to do is acceptable. <br /> <br />Mr. Olson questioned Mr. Packer if his method would plug the hole at the liner or the sand to <br />which Mr. Packer responded it does both. Mr. Olson stated that sand at the liner is meant to be <br />there and wondered ifthis would be a band-aid fix. Mr. Packer stated he could not be sure. <br /> <br />Attorney Goodrich stated that a comment had been made by the developer that staff had not been <br />forthcoming. He inquired if the developer felt staff has more information that they are <br />withholding. <br /> <br />Mr. Packer replied no - not that staff is withholding information - but maybe withholding <br />recommendations. <br /> <br />Mr. Himmer stated that Mr. Packer has come up with some solutions; however, we do not have <br />all the information to be able to give a total answer. <br /> <br />Mr. Olson stated that we are all trying to get this resolved as quickly as we can and added that all <br />he wants is to see water back into the pond. If polymer will fix it and not cause the City a major <br />headache in the future, it would be great - but he didn't know if the problem would still be fixed <br />15 to 20 years from now. <br /> <br />Public Works Committee - February 19,2008 <br />Page 7 of9 <br />
